employees required to obtain the license to perform their duties, and ail employees <br />promoted to such positions. The employer's obligation shall be limited to the first test an <br />employee takes, and to the first license he/she obtains. <br />Section 3. In the event that an employee loses his CDL or is not successful in <br />passing the CDL exam, the employer shall place the employee into another available job <br />he is capable of performing at his regular rate of pay, provided it falls within the new <br />job's wage schedule, or at the top of the new job's wage schedule if his regular rate of <br />pay does not fali within the new job's wage schedule. Such placement shall supersede <br />lateral transfers, the posting procedure, and work week or shift preference transfers. <br />Section 4. If no job is available, the employee shall be laid off until such time as <br />a job is available or until such time as he obtains his CDL, whichever is sooner. Upon <br />obtaining his CDL, the employee shall be returned to his previous job. <br />Section 5. Employees required to take the driving portion of CDL exam shall be <br />permitted to use a City vehicle for that exam. <br />ARTICLE 44 - UNIFORMS <br />Section 1. The City shall within thirty (30) days following the execution of this <br />agreement, poll each member of the bargaining unit regarding their desire to be <br />provided a uniform. For those employees indicating a desire to be provided uniforms, <br />the City shall continue to provide such uniforms. The City shall provide eleven (11) shirts <br />and pants (long sleeve in winter months and short sleeve in summer months) to #hose <br />employees. All employees that elect to receive uniforms shall wear such uniforms during <br />ali working hours. Employees that have elected not to be provided uniforms, may wear <br />T- shirts or other reasonable attire in lieu of the uniforrr shirt. <br /> <br />43 <br />
