If the Employer £ails to reply within the <br />speci£ied time limit, the qrievance shal.l automatically <br />be sustained in favor af the grievant. The time limits <br />specified for either party may be extended_anly by <br />written mutual agreement. <br />h) This pxocedure shall not be used for the puxposes of <br />adding to, subtracting fxom, 4r alterinq in any way, any <br />of the provisions of this Agreement. <br />SECTION 4: A11 grievances shali be administered i.n accordance <br />with the followirig steps in the grievance pxocedure. <br />SteD 1:_ An employee who believes he may have a grievance <br />shall notify his immediate supervisar, on the shift that the <br />grievance occurred, af the possible grievance within f ive (5) <br />days of the occuxxence of the facts qivinq rise to the qrievance. <br />The supervisar wilx schedule an infoxmal meeting with the <br />Administx'ative Gaptain of the Police t7epartment or his desxgnee, <br />the employee and an OPB,A representative, if such representation <br />is requts-sted by the employee, within five (a) days of the natice <br />by the employee, at which time the issue %n dispute wi1l be <br />discussed with the objective of resolving the matter informally. <br />Step 2: zf the dispute is riot resolved infarma2ly at Step <br />1, xt shall be reduced to writXr,g by the gxievant and presented <br />as a grievance ta the Ch;ief of police or ha.s desxgnee within five <br />(5) days of the informa2 meeting or notificatxon of the <br />supervisorts decision at Step 1, whichever is later, but not <br />later than seven (7) days fram the date of the meeting if the <br />supexvisnr fails to give the employee an answer. The Ghief of <br />Police or his designee shall give ,his answer within five (5) days <br />of the meeting. <br />Step 3: If the grievant is not satzsfied with the wrxtten <br />decision at the conclusion af Step 2, a wxitten appeal of the <br />decision may be filed with the Safety Director within f ive (5) <br />days af the date of the rendering af the decision at step 2. <br />Capies of the written decisi4ns shall be submitted with the <br />appeal. The Safety Direetor shall convene a hearirig witihin ten <br />(10) daXs af receipt of the appea2. The heaxing will be hel.d with <br />9 <br />
