P. 11 <br />-'r f._,r r ?1 <br />unresalved questions or disputes concerning the interpretation <br />and applicaCian of thi.s Ar}reement. <br />A grievance can be initiated by the OP$A or an aggrieved <br />bargaining uni.t employee. Where a group of bargaining unit <br />employees desires to file a grievance involving a situatian <br />afPecting each such bargaxning unxt emplayee in the same manner, <br />one bargaining unit employee selected by such grvup shall process <br />the qrievance(s). <br />SEcTION 3: The following procedures shall apply to t.he <br />administration of all gx'ievances filed under this procedure. <br />a} Except zn Step 1, all grievances shall include the name <br />azzd positi.on of the grievant, the identxty of the <br />provxsions of this agreement involved in the gra.evance; <br />the ti-me and place where the alleged events or <br />conditions giving rise to the grievance took pl.ace, the <br />identity of the party responsible for causing the said <br />gxievance, if knawn to the grievant; and a general <br />statement of the nature of the grievance and the redress <br />sdught by the grievant. <br />b) Except at Step 1, aIl decisions shall be rendex'ed in <br />wxiting at each step of the grievance praaedure. Each <br />decision shall be transmitted to the grievant and <br />his repz•esentative, if any. <br />c) If a grievance affects a group of employees warking in <br />diffexent locations, with different px.incipals, or <br />associated with an employer-wide controversy, it may be <br />submitted in Step 3. <br />d) Nothing contained herein shall be cdnstrued as limiting <br />the right af any employee having a grievance ta discuss <br />tihe matter informally with any apprapriate member of the <br />adminxstration within the chain of camtaand of the <br />PoYice Departmenr and havzrig said matter xnfaz-mally <br />adjusted without the znterventXon of the OPBA, provided <br />that the adjustment is not inconsistent with the terms <br />of this ,Agreement. In the event that the grievance is <br />adjusted without Eormal determXnation, pursuant to this <br />procedure, while such adjustment shall be binding upon <br />the grievant and shall, in a12 respects, be final, <br />adjustment shall not create a precedenti or ruling <br />binding upon the Eznployer in future pxoceedings. <br />e) The grievant may choose whamevex he wishes to represent <br />him at any step of the grievance procedure aFter Step 1. <br />f) The existence of this Grievance Procedure, hereby <br />established, shall nat be deemed to require ariy employee <br />8
