ARTICLE XIII <br />PART-TIME EMPLOYEES <br />Section 13.01. The City and the NOTEA recognize the need for part-time employees within <br />the Transit Department. However, it is mutually understood that such part-time employees are <br />intended to supplement the cunent full-time classifications. It is further understood by both <br />parties that management does not intend to layoff or arbitrarily replace current full-time employees <br />for the sole purpose of replacing witt? part-time employees. It is understood by both parties that <br />the intent is to replace full-time with part-time as attrition occurs and or the need for additional <br />personnel is required. <br />Section 13.02. Part-time employees shall be permitted to work in any job classification, except <br />may not be permitted to work as mechanics and material handlers. This section excludes work <br />hours credited to summer work programs, seasona( and students. <br />Section 13.03. <br />A. In the classification of bus operator: part-time operators will be limited to no more than <br />twenty-three percent (23%) of the full-time pick roster. <br />B. A"full-time operator" refers to an employee who is regularty scheduled to work forty (40) <br />hours per week. <br />C. A"part-time operator" refers to an employee working less than thirty (30) hours per week <br />or less. If an employee is not a part-time operator, then he shall be considered a full-time <br />operator. <br />Section 13.04. A. In the classification of hostler: part-time hostlers will be limited to a ratio of up to 1.6 <br />part-time hostlers to one (1) full-time. (e.g. 5 full-time hostlers to 8 part-time hostlers. Rounding <br />to the nearest whole number). <br />B. A full-time "hostler" refers to an employee who is regularly scheduled to work forty (40) <br />hours per-week. <br />C. A part-time "hostler" refers to an employee working thirty (30) hours per week or less. <br />If a hostler is not a"part-time" employee, then he shall be considered a fult-time hostler. <br />D. In the classification of full-time "hostler"; the start of the day shift shall not be later than <br />12:00 noon. The start of the night shift shall not be later than 5:00 p.m. <br />ARTICLE XIV <br />SE1vIORITY AND LAYOFF <br />Section 14.01. Seniority shall be determined by continuous service with the Transit <br />Department. Continuous service shall only be broken by retirement, resignation or discharge. <br />One senority list shall be maintained for full-time employees. T'he seniority of an individual shall <br />not accrue for those days not worked when an employee is in a"no pay" status (e.g. off on sick <br />leave without pay, off on a leave of absence without pay, off due to a disciplinary suspension) <br />any of which exceeds the greater of ten (10) days or eighty (80) hours in a calender year. Any <br />time above ten (10) days or eighty (80) hours in a calender year will not count toward the accrual <br />of seniority. Provided, however, an employee in "no pay" status and off without the use of sick <br />leave due to a work related injury or occupational disease shall continue to accrue seniority for <br />?Y a period not to exceed one year. Accordingly, if an employee is not accruing seniority and a less <br />senior employee is accruing seniority, the less senior employee could accrue sufficient seniority <br />to equal or surpass in seniority the employee whose seniority is not accruing. <br />
