Section 14.02 Seniority within the Transit Department shall govern for all purposes, except <br />for the scheduling of runs for operators only, which shall be governed onthe basis of seniority <br />within the operator's classification. The operators having the most seniority, during a run pick, <br />shall have the first choice of runs and so on down the list until all runs are filled. Any runs or <br />assignments which are not picked for any particular day shall be assigned to the first extra <br />operator for that day from the bottom of the seniority list. <br />Section 14.03. Where because of economy, consolidation or otherwise, the employer <br />determines it necessary to reduce the size of its work force, such reduction shall not be made <br />without notifying the NOTEA. <br />Section 14.04. Whenever the employer deems it necessary to reduce the number of employees <br />within any classification with the Transit Department the least senior full-time employee within <br />that classification covered by this agreement shall be laid off first. When the seniority of two or <br />more employees is equal, employees shall be laid off by the drawing of lots. In the event of a <br />layoff, the affected employees shall receive payment of any unused vacation as quickly as <br />practicable but no later than fourteen (14) calender days following the date of layoff. <br />Section 14.05. <br />A. Should a position with the Transit Department be re-created or re-established the most <br />senior employee on lay off status shall be recalled to fill the position providing management <br />believes that the employee on layoff status has the skills necessary, knowledge and the ability <br />to perform the duties of the position. Should the employer recall a laid off employee and the <br />employee fails to satisfactorily demonstrate the skills necessary, the knowledge and ability to <br />satisfactorily perform the required job task within seven (7) days, said employee shall be <br />placed on layoff status and the next less senior employee on layoff status shall be recalled. <br />Again, this employee must also satisfactorily perform and demonstrate the skills necessary, <br />knowledge and ability to perform the job task. Shoutd the employee fail to do so, he shall <br />be placed back on layoff status. An employee on layoff status will be given notice of his <br />recall by U.S. Certified Mail, to the last known address of record. <br />B. If an employee laid off as prescribed within the aforementioned section enters in the <br />"active service" of the U.S. Armed Forces, such period of service shall nor be counted in the <br />recall period. The recall period is twenty-four (24) months for such employees. The <br />minimum requirements as a member of the Reserve does not constitute "active service" <br />for the purpose of this section. <br />G. The recalled employee shall within seven (7) calender days following the date of receipt for <br />the attempted date of delivery of such notice to appear in person and meet with the <br />General Manager of the Transit Department or his designee. Failure on the part of the <br />recalled employee to appear as required shall result in a loss of any present and future right <br />to recall. Employees on recall status shall retain the right to recall for a period of time equal <br />to his seniority but in no event shall any employee retain recall rights beyond twenty-four <br />(24) months following the date of layoff. It is the responsibility of the employee to inform <br />the employer of his correct address. When an employee meets with the General Manager <br />within the aforementioned time period and declines to return to work or fails to respond within <br />the set time period, his name shall be removed from the recall list. <br />
