D. The employer shall hand deliver a written layoff notice to the affected employee(s) on his <br />regular shift fourteen (14) days prior to the effective date of the layoff. Employees who have <br />completed their probationary period shall be permitted to bump the least senior full-time <br />employee within the Transit Department, providing the employee with the greater seniority <br />can satisfactorily demonstrate to the employer that he possesses the necessary skills along <br />with the knowledge and ability to perform the required job task of the position he wishes to <br />bump. Upon receipt of the layoff notice as described above, the affected employee (s) wishing <br />to bump shall immeditely request the employer to provide him a"bump form". The employee <br />shall compiete the form and return the same to the General Manager or his designee a minimum <br />of seven (7) days following receipt of the layoff notice. The employer shall review the <br />completed form and based on the emp(oyees work experience demonstrate that he can perform <br />the task required of the bump position, the General Manager or his designee shali authorize <br />and approve the bump. The employee shall be required to satisfactorily demonstrate that he <br />can perform the job task within seven (7) days. Should the employee fail to satisfactorily <br />perform the job task with the time limit set above, he shatl be placed on layoff status effective <br />at the end of the shift of the 7th day. Employees who are placed on tayoff status under these <br />conditions shall forfeit and not maintain further rights to bump. The employee shall however, <br />maintain recall rights as cited within Section 14.05 sub-section A and B. The least senior full- <br />time employee who has received a tayoffnotice may be permitted to bump the most senior <br />part-time employee with the Transit Department providing all of the terms and conditions <br />described within this Article have been met by the employee. Any emptoyee (s) exercising <br />the condition stated within this section shall have his full-time seniority frozen effective the <br />date listed on the layoff notice and shall retain such full-time seniority for a period of time <br />not to exceed that which is listed in Section 14.05 C of the Article for the purpose of <br />recall to full-time status. Any further bumping by a full-time employee into a part-time <br />position shall use a"bump back" procedure, i.e. the first full-time employee who bumped into the <br />most senior part-time position shall be entitled to bump back to the second most senior part-time <br />position should another former full-time employee subsequently bump back to the most <br />senior part-time position, etc. Effective the first day of employment as a part-time employee, the <br />terms and conditions of employment, compensation and benefits to be paid and enjoyed by <br />part-time employees will conform with those listed in Ordinance Number 94-07, except the <br />terms, conditions and intent contained within Section 2 of Ordinance Number 94-07 and any <br />subsequent Ordinances that may be adopted by the North Olmsted City Council which repeai, <br />amend or modify Ordinance Number 94-07. Full-time employees who bump into a part-time <br />classification shall not retain any rights and or benefits afforded by virtue of this agreement <br />except those expressly stated within this Article. Management's right to layoff, recall, <br />to approve and or deny bump request shall not be subject to the grievance procedure. <br />Section 14.06. The City and the NOTEA recognize the need for part-time employees <br />within the Transit Department. However, it is mutually understood that such part-time <br />employees are intended to supplement the current full-time classifications. It is further <br />understood by both parties that management does not intend to layoff or azbitrarily replace <br />current full-time empioyees for the sole purpose of replacing with part-time employees. It <br />is understood by both parties that the intent is to replace full-time with part-time as attrition <br />occurs and or the need for additional personnel is required. <br />Section 14.07. During the period a full-time employee is on lay-off, he may continue his hea(th <br />plan coverage; at his own expense, provided during active employment with the Employer, and <br />7
