any improvements made in that hea(th plan coverage. <br />Section 14.08. The Employer shall continue to provide NOTEA with a cunent recall list. <br />ARTICLE XV <br />DISCIPLINE <br />Section 15.01. A. non-probationary employee who is disciplined shall be given a written <br />notice of such discipline stating the reason(s) thereof, within five (5) days from the date of such <br />action. The NOTEA shall have the right to have a representative at every step of the disciplinary <br />process. <br />Section 15.02. Any non-probationary employee who is disciplined shall be able to appeal <br />such disciplinary action only through the Grievance Procedure herein contained. <br />Section 15.03. An employee may review his personnel file upon reasonable notice. The <br />Employer and the employee may have a representative present when this review occurs. <br />Section 15.04. Written reprimands and records of verbat reprimands other than accidents; that <br />are more than twenty-four (24) months old shall not be used against the employee, provided there <br />has been no subsequent disciplinary action during said period. <br />Section 15.05. An employee shall be informed of any complaints made about his performance <br />000 ` and shall be given the opportunity to meet with the Operations Manager or Maintenance Manager, <br />or his designee, depending on classification, to discuss said complaints. The employee shall have <br />the right to have a representative of the NOTEA present when such complaints are discussed. <br />Section 15.06. An employee shali be notified when garnishment orders are received by the <br />Employer. Such notification shall be given as soon as reasonably possible. <br />Section 15.07. Discipline shall be applied as per Conditions of Employment and Rules and <br />Regulations Manual that came into effect June 17, 1990. (i.e. Green Book) <br />Section 15.08. Progressive discipline for chargeable accidents, within an eighteen (18) month <br />period, shall be applied as follows: <br />First Chargeable Warning Letter <br />Second Chargeable One (1) to Five (5) Day suspension with possible retraining. <br />Third Chargeable Thirty (30) Day suspension or discharge. <br />Fourth Chargeable Discharge <br />Management reserves the right to waive the above disciplinary action called for, based on the <br />degree of seriousness of the accident, upon investigation. <br />Section 15.09. The Employer shall provide to the NOTEA a copy of all written disciplinary <br />actions against members of bargaining unit. The NOTEA will provide listing of all cunent <br />;; members to the General Manager. <br />?- <br />
