CITY OF NORTH OLMSTED <br />ORDINANCE NO. 95-25 <br />By: . Councilmember Miller <br />AN ORDINANCE AMENDING CHAPTER 941 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED ENTITLED "REFUSE COLLECTION" BY <br />CREATING SECTION 941.04 THEREIN ENTITZED <br />"PLACEMENT AND COLLECTION OF RECYCLABLE <br />MATERIALS" AND DECLARING AN EMERGENCY AS <br />AMENDED. <br />WHEREAS, Council for the City of North Olmsted is desirous of enacting legislation <br />to regulate the placement and collection of recyclable materials within the public right of <br />way; and <br />WHEREAS, recyclable materials placed within the public right of way for purposes of <br />collection and salvage by entities contractually obligated to the City of North Olmsted has <br />been removed and converted to personal use by entities or persons not authorized to do so <br />thereby depriving said contractually obligated entities of an exclusive benefit of said contract. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTIDN 1: That there is hereby established a new section 941.04 of the Codified <br />Ordinances of the City of North Olmsted entitled "Placement and collection of recyclable <br />materials," which shall read as follows: <br />941.04 PLACEMENT AND COLLECTION OF RECYCLABLE MATERIALS. <br />(a) Occupants of residential units shall separate accumulated recyclable materials <br />according to the following categories: (a) clear and colored glass, aluminum and steel cans, <br />and numbers " 1 " and " 2 " stamped plastic containers; and (b) newspapers. Occupants shall <br />place their separated materials within blue colored plastic bags and these materials shall be <br />placed within the public right of way for collection.
