<br />ti <br />r' <br />Ordinance 95-25 <br />Page 2. <br />ordinance, the public right of way appropriate for placement and collection of recyclable <br />materials shall be limited to residential curbside treelawns. Such recyclable materials sha11 <br />be so placed in the public right of way no earlier than the evening preceding collection by <br />the City of the street which the treelawn or other azea abuts. The date or day for collection <br />of recyclable materials for an occupant of a residential unit shall correspond to the date or <br />day of collection of garbage or rubbish. <br />(b) Upon the placement of recyclable materials in accordance with provision (a) <br />herein, said materials become the property of the City of North Olmsted. <br />(c) Once recyclable materials aze placed for collection in accordance with <br />provision (a) herein, no person, other than authorized City or City contractor personnel, sha11 <br />remove said recyclable material. Any and each collection or removal by unauthorized <br />persons in violation of the provisions of this ordinance, from one or more designated <br />collection places, shall constitute a separate and distinct offense. For each separate offense, <br />the individual shall be guilty of a minor misdemeanor and be fined not more than one <br />hundred dollazs ($100.00). <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />necessary for the preservation of the public health, safety and welfaze, and provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall go into <br />immediate force and effect upon its signing by the mayor. <br />.- <br />PASSED: <br /> <br />i <br />7CLEP <br />JAMES BOEHMER, <br />PRESIDENT OF COUNCIL <br />A T.• <br />!
