BY: CITY OF NORTH OLMSTED ORDINANCE NO. 72- /G 3 AN ORDFINANCE ENACTING SECTION 533.11 OF THE GENERAL OFFENSES CODE OF THE CITY OF NORTH OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- TITLED "POSSESSION OF HYPODERMIC ;EXCEPTIONS ; CONTROL PRECAUTIONS " TO CONFORM TO GRANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DE- CLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted General Offenses Code be reviewed to eliminate any conflicts with the provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That Section 533.11, Chapter 533 (Codified Ordinances) of the North Olmsted General Offenses shall read4es follows 533.11 POSSESSION OF HYPODERMIC ;EXCEPTIONS ;CONTROL PRECAUTIONS. (a) Except as provided in subsection (b) hereof, no person shall possess a hypodermic. (b) Subsection ~(a) hereof does not prohibit the possession of a hypodermic by any of the following : (1) Any manufacturer or distributor crf or dealer in, hypodermics or medication packaged in hypodermics, and any authori:ed agent or employee of such manufacturer, distributor or dealer, in the regular course of business ; (2) A hospital, owner of a pharmacy or pharmacist, in the regular course of business ; (3) Any practitioner, nurse or other person authorized to administer injections, in the regular course of his profession or employment ; (4) Any person, when the hypodermic in his possession was lawfully obtained and is kept and used for the purpose of self-adminis- tration of insulin or other drug prescribed by a practitioner for the treatment of disease ; (5) Any person whose use of a hypodermic is for Iegal research, clinical or medicinal purposes ; (6) Any farmer, for the lawful administration of a drug to an animal.
