<br />BY: <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- /G 3 <br />AN ORDFINANCE ENACTING SECTION 533.11 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- <br />TITLED "POSSESSION OF HYPODERMIC ;EXCEPTIONS ; <br />CONTROL PRECAUTIONS " TO CONFORM TO GRANGES <br />ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DE- <br />CLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted by <br />the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 533.11, Chapter 533 (Codified Ordinances) of the <br />North Olmsted General Offenses shall read4es follows <br />533.11 POSSESSION OF HYPODERMIC ;EXCEPTIONS ;CONTROL <br />PRECAUTIONS. <br />(a) Except as provided in subsection (b) hereof, no person shall <br />possess a hypodermic. <br />(b) Subsection ~(a) hereof does not prohibit the possession of a <br />hypodermic by any of the following : <br />(1) Any manufacturer or distributor crf or dealer in, hypodermics <br />or medication packaged in hypodermics, and any authori:ed <br />agent or employee of such manufacturer, distributor or dealer, <br />in the regular course of business ; <br />(2) A hospital, owner of a pharmacy or pharmacist, in the regular <br />course of business ; <br />(3) Any practitioner, nurse or other person authorized to administer <br />injections, in the regular course of his profession or employment ; <br />(4) Any person, when the hypodermic in his possession was lawfully <br />obtained and is kept and used for the purpose of self-adminis- <br />tration of insulin or other drug prescribed by a practitioner for <br />the treatment of disease ; <br />(5) Any person whose use of a hypodermic is for Iegal research, <br />clinical or medicinal purposes ; <br />(6) Any farmer, for the lawful administration of a drug to an animal. <br /> <br />
