<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72-~,~ ~ PAGE 2 <br />(c) No manufacturer or distributor of, or dealer in, hypodermics <br />or medication packaged in hypodermics, or their authorized <br />agents or employees, and no owner of a pharmacy pr pharma- <br />cist, shall display any hypodermic sale. No person author- <br />ized to possess a~hypodermic pursuant to subsection (b) hereof <br />shall negligently fail to take reasonable precautions to prevent <br />any hypodermic in his possession from theft or acquisition by <br />any unauthorized person, or negligently discard a hypodermic <br />without first having rendered it completely unusable for its <br />original purpose. <br />(d) A pharmacist or person under the direct supervision of a pharma- <br />cist may furnish hypodermics to another without a prescription <br />by a practitioner, but the pharmacist or person under his super- <br />vision shall require positive identification of each person to <br />whom hypodermics are furnished, and shall keep a written <br />record of each transaction, including the date, the type and <br />quantity of the articles furnished, and the name, address and <br />signature of the person to whom such articles are furnished. <br />Such record shall be retained in the same manner as the exet~apt <br />narcotics register. No pharmt~cist or person under his super- <br />vision shall fail to comply with this subsection in furnishing <br />hypodermics. <br />(e) As used in this section , "hypodermic " means a hypodermic <br />syringe or needle, or other instrument or device for the subcu- <br />taneous injection of medication. (ORC 3719.172 ) <br />(f) Whoever violates subsection (a) hereof shall, for a first <br />offense, be guilty of a misdemeanor. <br />Section 2. That any ordinance or parts of ordinances, or resolutions or <br />pares of resolutions, inconsistent with the provisions of this Ordinances are here- <br />by repealed with the effective date of this Ordinance . <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by vittue~of the fact that Section 533.11 prior to this amend- <br />ment is in conflict with the provisions of the State Statutes.
