CITY OF NORTH OLMSTED ORDINANCE NO. 72-~,~ ~ PAGE 2 (c) No manufacturer or distributor of, or dealer in, hypodermics or medication packaged in hypodermics, or their authorized agents or employees, and no owner of a pharmacy pr pharma- cist, shall display any hypodermic sale. No person author- ized to possess a~hypodermic pursuant to subsection (b) hereof shall negligently fail to take reasonable precautions to prevent any hypodermic in his possession from theft or acquisition by any unauthorized person, or negligently discard a hypodermic without first having rendered it completely unusable for its original purpose. (d) A pharmacist or person under the direct supervision of a pharma- cist may furnish hypodermics to another without a prescription by a practitioner, but the pharmacist or person under his super- vision shall require positive identification of each person to whom hypodermics are furnished, and shall keep a written record of each transaction, including the date, the type and quantity of the articles furnished, and the name, address and signature of the person to whom such articles are furnished. Such record shall be retained in the same manner as the exet~apt narcotics register. No pharmt~cist or person under his super- vision shall fail to comply with this subsection in furnishing hypodermics. (e) As used in this section , "hypodermic " means a hypodermic syringe or needle, or other instrument or device for the subcu- taneous injection of medication. (ORC 3719.172 ) (f) Whoever violates subsection (a) hereof shall, for a first offense, be guilty of a misdemeanor. Section 2. That any ordinance or parts of ordinances, or resolutions or pares of resolutions, inconsistent with the provisions of this Ordinances are here- by repealed with the effective date of this Ordinance . Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, safety, health and welfare by vittue~of the fact that Section 533.11 prior to this amend- ment is in conflict with the provisions of the State Statutes.
