<br />CITY OF NORTH OLMSTED ORDINANCE NO. 72- ~~~ PACE 4 <br />(k) No person who is authorized by an issuer to furnish money, goods, <br />services or anything else of value upon presentation of a credit <br />card by a cardholder or any agent or employee of such person shall, <br />with intent to defraud the issuer or the cardholder, fail to furnish <br />money, goods, services or anything else of value which he repre- <br />sents in writing to the issuer that he has furnished. <br />(1 ) No person shall receive money, goods, services or anything else <br />of value obtained in violation of this section, knowing or believing <br />that it was so obtained. A person who obtains at a discount price <br />a ticket issued by an airline, railroad, steamship or other trans- <br />portation company, which was acquired in violation of this section, <br />without reasonable inquiry to ascertain that the person from whom <br />it was obtained has a legal right to possess it. , shall be presumed <br />to know that such ticket was acquired under the circumstances con- <br />stituting aviolation of this section. <br />(m) This section saall not be construed to preclude the applicability of <br />any other provision of the criminal law of this State, unless such <br />provision inconsistent with the terms of this section. <br />(n) Whoever violates ~y provision of this section shall be guilty of <br />a misdemeanor if the value of the money, goods, services or any- <br />thing else of value so obtained, or attempted to be obtained, is <br />less than sixty dollars ($60.00) . (ORC 2907.201 ) <br />Section 2. That any ordinance or parts of ordinances, or resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediare preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 537.13, prior to this amend- <br />ment is in conflict with the provisions of the State Statutes. WHEREFORE, this <br />Ordinance shall take effect and be in force immediately upon its passage, other- <br />wise, at the earliest period allowed by law. <br />PASSED: ~ +~ ~ , <br />ATTEST: <br />G~~ ~f <br />Nora T.
