CITY OF NORTH OLMSTED ORDINANCE N0. 71- rp AN ORDINANCE CONSENTING TO THE INSTALLATION ON LORAIN ROAD OF TRAFFIC CONTROL DEVICE AS HEREIN DESCRIBED UNDER THE SUPERVISION OF THE COUNTY OF CUYAHOGA AND DIRECTOR OF HIGHWAYS, STATE OF OHIO, AND DECLARING AN EMERGENCY. WHEREAS, the County of Cuyahoga and the Director of Highways, Btate of Ohio, are considering the traffic control device installation project on Lorain Road within the Municipal Limits of the City of North Olmsted which is described as follows: Update and upgrade all existing traffic control signals, signs, and pavement markings to facilitate the movement of traffic. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted: Section 1. (Consent) That it is declared to be in the public interest that the consent of said Municipality be and such consent is hereby given to the County of Cuyahoga and the Director of Highways, State of Ohio, to construct the above described installation project, in accordance with plans, specifications and estimates as approved by the County and the Director of Highways, State of Ohio. Section 2. (Cooperation) That said Municipality hereby proposes to cooperate with the County and the Director of Highways, State of Ohio, in the cost of the above described improvement as follows: (a) By preparation of the traffic control device plans and speci- fications for the installation of this project. (b) By participation in the project cost to the extent of installa- tion supervision and installation inspection costs. (c) By participation of One hundred percent (100%) of the cost of any property damage resulting from this installation project, all within the Municipal limits. Section 3. (Authority to Sign) That the Mayor of said Municipality is hereby authorized to enter into maintenance and parking agreements and special contractual obligations. Section 4. (Maintenance and Parking) That upon completion of said installa- tion project said Municipality will thereafter keep said highway open to traffic at all times, and (a) Maintain the installation project in accordance with the provisions of the statutes relating thereto and make ample financial provisions for such maintenance. (b) Maintain the right-of-way and keep it free of obstructions in a manner satisfactory to the County and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboards, roadside stands or other private installations within the right-of-+~ay limits; and (c) Prohibit parking within the limits of the installation project under this ordinance, within the corporate limits of the Muni- cipality; and (d) No rule or regulation shall be enacted restricting the use of the highway by any class of vehicle or vehicle load permitted by the
