<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 71- rp <br /> <br />AN ORDINANCE CONSENTING TO THE INSTALLATION ON LORAIN <br />ROAD OF TRAFFIC CONTROL DEVICE AS HEREIN DESCRIBED <br />UNDER THE SUPERVISION OF THE COUNTY OF CUYAHOGA AND <br />DIRECTOR OF HIGHWAYS, STATE OF OHIO, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the County of Cuyahoga and the Director of Highways, Btate <br />of Ohio, are considering the traffic control device installation project <br />on Lorain Road within the Municipal Limits of the City of North Olmsted <br />which is described as follows: <br />Update and upgrade all existing traffic control signals, <br />signs, and pavement markings to facilitate the movement <br />of traffic. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted: <br />Section 1. (Consent) That it is declared to be in the public interest <br />that the consent of said Municipality be and such consent is hereby given to <br />the County of Cuyahoga and the Director of Highways, State of Ohio, to <br />construct the above described installation project, in accordance with <br />plans, specifications and estimates as approved by the County and the <br />Director of Highways, State of Ohio. <br />Section 2. (Cooperation) That said Municipality hereby proposes to cooperate <br />with the County and the Director of Highways, State of Ohio, in the cost of <br />the above described improvement as follows: <br />(a) By preparation of the traffic control device plans and speci- <br />fications for the installation of this project. <br />(b) By participation in the project cost to the extent of installa- <br />tion supervision and installation inspection costs. <br />(c) By participation of One hundred percent (100%) of the cost of <br />any property damage resulting from this installation project, <br />all within the Municipal limits. <br />Section 3. (Authority to Sign) That the Mayor of said Municipality is hereby <br />authorized to enter into maintenance and parking agreements and special <br />contractual obligations. <br />Section 4. (Maintenance and Parking) That upon completion of said installa- <br />tion project said Municipality will thereafter keep said highway open to <br />traffic at all times, and <br />(a) Maintain the installation project in accordance with the <br />provisions of the statutes relating thereto and make ample <br />financial provisions for such maintenance. <br />(b) Maintain the right-of-way and keep it free of obstructions in <br />a manner satisfactory to the County and hold said right-of-way <br />inviolate for public highway purposes and permit no signs, posters, <br />billboards, roadside stands or other private installations within <br />the right-of-+~ay limits; and <br />(c) Prohibit parking within the limits of the installation project <br />under this ordinance, within the corporate limits of the Muni- <br />cipality; and <br />(d) No rule or regulation shall be enacted restricting the use of the <br />highway by any class of vehicle or vehicle load permitted by the <br /> <br />
