<br />Ordinance No. ,~-(, ~ Page 2 <br />Ohio Revised Code to use a public highway. Any existing rule or <br />regulation so restricting road usage is hereby rescinded. <br />Section 5. (Traffic Control Signals and Devices) That traffic control <br />signals will not be installed on the project without prior approval by the <br />County and the Director of Highways, State of Ohio, and the Municipality <br />will place and maintain all traffic control devices conforming to the Ohio <br />Manual of Uniform Traffic Control Devices on the installation project in <br />compliance with the provisions of Section 4511.11 and related sections of <br />the Ohio Revised Code. <br />Section 6 (Utility Rearrangement) <br />(a) That arrangements shall be made with and agreements obtained <br />from all public utility companies whose facilities will be affected <br />by the said installation project and said companies shall agree <br />to make any and all necessary rearrangements of facilities in <br />such a manner as to be clear of any construction called for by <br />the plans of said improvement and said companies shall agree to <br />make such necessary rearrangements immediately after notification <br />by said Municipality or the County of Cuyahoga. <br />(b) That it is hereby agreed that the Municipality shall at its own <br />expense make alI rearrangements of both munic3Qally owned and <br />px~rattely owned utilities and/or any appurtenances thereto, as <br />may be necessary to conform to the said installation project and <br />said rearrangements shall be done at such time as requested by <br />the County. <br />(c) That the construction, reconstruction and/or rearrangement of <br />both publicly and privately owned utiliti+~s, referred to in sub- <br />sections (a) and (b) above, shall be done in such a manner as not <br />to interfere unduly with the operation of the contractor install- <br />ing the project and all backfilling of trenches made necessary by <br />such utility rearrangements shall be performed in accordance with <br />the provisions of the Ohio Department of Highways Construction and <br />Material Specifications and shall be subject to approval by the <br />County. <br />Section 7. (Emergency Clause) This ordinance is hereby declared to be an <br />emergency ordinance immediately necessary for the preservation of the public, <br />peace, health and safety, such emergency existing by reason of the present <br />condition of said road and by reason of the inadequacy of such road to handle <br />existing and anticipated vehicular traffic between the points hereinbefore <br />designated; in consequence whereof great public inconvenience is being <br />suffered and will be suffered and public vehicular traffic endangered and <br />delayed; and for the further reason that it is necessary to proceed at once <br />in order to complete the installation project on said road during the <br />coming year.
