<br />70-136 <br />- 9 - <br />the purchase of supplies or materials without public advertising <br />and bidding in the case of a real and present emergency arising <br />in connection with the operation and maintenance of the Depart- <br />ments of Public Service and Public Safety." <br />8. That Section 8 of Article VIII of the Charter be amended to increase <br />the 11.1 mill municipal unvoted tax limitation to 14 mills, which <br />includes the amounts needed for debt service on unvoted bonds, the <br />amounts required for police and firemen's pensions, and earmarked <br />rates of 1.5 mills for parks and recreation and .3 mill for implementa- <br />tion of recommendations of the advisory commission on juvenile delin- <br />quency, such amended Section 6 of Article VIII to read as follows: <br />'°Article VIII, Section 8: Limitation on the Rate of Taxation <br />The aggregate amount of taxes that may be levied by the <br />Council, by a two-thirds affirmative vote of the members eligible <br />to vote, without a vote of the people, on any taxable property <br />assessed and listed for taxation according to value, for all <br />purposes of the municipality, shall not in any one year exceed <br />fourteen (14.0) mills for each dollar of assessed valuation. Of <br />said total maximum levy, an amount shall annually be levied <br />sufficient to pay the interest, sinking fund and retirement <br />charges on all notes and bonds of the municipality heretofore <br />or hereafter authorized to be issued without the authority of <br />the electors, which levy shall be placed before and in preference <br />to all other levies and for the full amount thereof. Of the <br />remaining portion of said total maximum levy, an amount shall <br />annually be levied sufficient to provide the amounts required <br />by law for police and firemen's pensions; an amount shall <br />annually be levied for the purpose of paying the expense of <br />parks and recreation and groviding park and recreational facil- <br />ities, exclusive of debt charges on notes and bonds issued for <br />such purpose, (1.5) mills; and beginning in tax year 1971 for <br />distribution in 1972, and thereafter, for the purpose of paying <br />the expense of the programs recommended by the advisory com- <br />mission established in Section 4, Item 3 of Article V of this <br />Charter (. 3) mills, and the balance thereof may annually be <br />levied for the purpose of paying the current operating expenses <br />of the municipality." <br />9. That Section 3 of Article X of the Charter be amended to require <br />recall petitions to be signed by electors eligible to vote for the <br />office to which the recall petition is directed equal in number to <br />25% of the votes cast for such office at the last election, such <br />amended Section 3 of Article X to read as follows: <br />"Article X, Section 3: Recall <br />Electors shall have the power to remove from office by <br />recall election, any elected official of the municipality. After <br />an elected official has served six months of his term, a petition <br />demanding his recall and removal may be filed with the Clerk of <br />Council. Such a petition shall be signed by electors eligible <br />to vote for the office to which the recall petition is directed <br />equal in number to twenty-five per cent (25%) of the total votes <br />cast for such office at the last election therefor. If the Clerk <br />shall find the petition sufficient he shall promptly so certify <br />to the Council, shall deliver a copy of such certificate to the <br />official whose removal is sought and make a record of such de- <br />livery.
