[ ii; <br />~. <br />., i <br /> <br />In consideration of the provisions of this Lease giving and granting to the <br />City exclusive possession, custody and control of the Project, the City hereby <br />assumes all risks in connection with any damage, loss or destruction of the <br />Project, or any part thereof, or any fixtures or equipment thereof from any <br />and all causes whatsoever, except in respect to the guarantee of CRC to keep <br />in good repair and proper working condition all structural and mechanical <br />improvements in accordance with Section 3(c) hereof and, in the event of any <br />such damage, loss or destruction, the City covenants and agrees to repair, <br />restore, rebuild or replace the same as nearly as possible to the condition <br />they were in immediately prior to such damage, loss or destruction either from <br />the proceeds of insurance as hereinabove in this section provided, or, to the <br />extent such proceeds of insurance are insufficient or unavailable therefor, <br />from monies derived from other sources. <br />Section 7. Quiet Enjoyment. CRC represents and agrees that the <br />City, paying the rent when due and keeping and performing all of the covenants <br />and agreements herein stipulated to be kept and performed on the City`s part, <br />shall hold and possess, occupy and enjoy the Premises a.nd Project without any <br />manner of hindrance or molestation from CRC. <br />Section 8. Waste. The City agrees to refrain from committing waste <br />on the premises and Project and to keep same in substantially as good condition <br />as at the commencement of the term of this Lease, damages from natural elements, <br />normal wear and tear, normal depreciation and decay expected. <br />Section 9. CRC's F,ntry. The City shall permit CRC or CRC's agents <br />to enter upon the Premises at all reasonable times to examine the condition <br />thereof and to determine the nature of the use and occupancy thereof. CRC <br />shall not exercise the right herein granted in such a manner as to interfere <br />with the City's normal. use and occupancy of the Premises. CRC, its successors <br />and assigns, hereby waives, relinquishes and xeleases any and all. ri.€;hts of <br />reentry, or to retake possessivn of the Project or the Premises and hereby <br />covenants and agrees nvt to exercise any such rights, in the event of tide <br />,. _ .,,.~ ~h~ <br />
