<br />.~ <br />-9- <br />failure of the City to make payment of the rent due hereunder or in the event <br />of any other default or defaults hereunder by the City. 7n the event of a <br />failure by the City to pay rentals provided for herein, the .nights of CRC, <br />its successors and assigns, shall be limited to any available remedy in law <br />or in equity to sue for and collect such rentals as the same become due from <br />time to time. <br />Section 10. Notice. Whenever it is provided in this Lease or in <br />the Deed of even date herewith, that notice is to be served on either of the <br />parties, it is understood that said notice shall be in writing and either <br />delivered personally or by registered mail, addressed to the CRC at 171+2 East <br />23rd Street, Cleveland, Ohio, 1+4114, and to the City at City Hall, 5206 Dover <br />Center Road, North Olmsted, Ohio, 44070, or at such other place or places as <br />the respective parties may hereafter designate, in writing. <br />Section 11. Assignment. This Lease shall inure to the benefit of <br />and be binding upon the successors and assigns of CRC; provided, however, <br />that the obligation of CRC under Section 3(c) and Section 5 shall not be <br />assignable without the consent of the City. The City shall not assign this <br />Lease or arty interest therein or sublet the Project or any part thereof. <br />Section 12. Surrender. At the end of the term of this Lease, or <br />the termination thereof by mutual agreement, or at any other time that CRC`s <br />interest in the Premises terminates pursuant to the terms of the Deed of even <br />date herewith, CRC agrees to surrender a.nd deliver to the City the Premises <br />and the Project and any other improvements that CRC has made on the Premises <br />at no cost and the Project and any other improvements shall become the ab- <br />solute property of the City. The parties shall execute all necessary and <br />appropriate documents to evidence the same; and, if such is the case, the <br />City shall execute and deliver to CRC a document to evidence that all covenants <br />and agreements assumed by CRC under this Lease have been performed in full. <br />This provision shall continue throughout the term of this Lease and shall sur- <br />vivo an,}r default by the City under this Lease. <br />_. ~,. _ , ....~,-may <br />
