C <br />'r <br />- 2 - <br />Section 3. That the Director of Finance of this City is hereby authorized <br />and directed to make the rental payments provided for 3.n Section 2 of the <br />lease agreement in the aarounts and at,,the times provided for therein ar~d it <br />is the further finding and dete:rm3.nation of this Council that the qusrterly <br />rental payments provided for in such Section 2, together with such additional <br />payments as rentals as provided for in such section, represent and constitute <br />fair and reasonable cos~ensat3.on and rental for the use, occupancy and esnjoy- <br />ment of the swimming pool facility to be paid to Coaetunity Recreation Company <br />by the City as a current operating expense on a quarterly basis as aforesaid <br />during the term of the lease. <br />Section ~+. That i.n accordance with Section 5705.44, Revi~aed Code, the <br />amount of the City's obligation under such lease agreemtent remaining unful- <br />filled at the end of any fiscal year and which will become payable during the <br />next fiscal year shall be included in the annual appropriation n-easure for the <br />next year as a fixed charge. <br />Section 5. That this ardinaACe is hereby declared to be an emergency <br />measure necessary for the mediate preservation of the public peace, health, <br />safety and welfare of said City and for the farther reason that provisions <br />should immediately be made for the execution of such lease agre~e®ent and deed. <br />in order to permit Community Recreation Company to proceed at the earlierst <br />possible date with the construction and development of such municipal. swimming <br />pool facility which is urgently required for the recreational p~rogreat of the <br />City to enhance and develop the health and welfare of the inhabitants of the <br />City; wherefore, this ordinance shall be in full force and effect from and <br />immediately after its passage and approval by the Mayor. <br />Passed: ~? /~'pp <br />Attest ; <br />1~~ ~ ~~~ <br />Nora T.
