CHRISTMAN <br />Mayor <br />June 4, 1970 <br />Council of the City of North Olmsted <br />City Hall <br />North Olmsted, Ohio <br />Dear Sirs; <br />~ ~ ~ h <br />Phone: 777-8000 <br />This is to advise you that I have disapproved and vetoed <br />Ordinance No. 70-93, passed June 2nd, 1970. <br />I fully recognize that a municipal swimm~ing pool is needed <br />in this City but I cannot let this need influence my judgment as the <br />chief executive officer of the City responsible for the administration <br />of the City's affairs. This responsibility requires me to look at all <br />aspects of the City's operations and not just the need for a particular <br />facility. <br />I am concerned that the City's obligation under the lease. <br />agreement authorized by the ordinance may constitute an indebtedness <br />which would cause the City to exceed the 11.1 mill limitation established <br />by the Charter of the City. In addition the obligation to pay at least <br />$335,000 over the ten year lease period may contribute a debt for <br />purposes of the statutory debt limitations applicable to the City and the <br />City has not followed the provisions of the Uniform Bond Law, Chapter 133, <br />Ohio Revised Code, with respect to the obligation under the lease <br />agreement. <br />I also question whether the City can convey real estate as <br />provided for in the deed without competitive bidding and whether the <br />arrangement under which Community Recreation Company would construct a <br />swiuaming pool and lease it to the City would be a violation of the <br />competitive bidding requirements of the Charter. The lease agreement may <br />also constitute a contract which requires a certification under Section- <br />5705.41, Revised Code, and the Finance Director is not in a position to <br />execute such a certificate with respect to total obligation of the City <br />under the lease agreement. <br />For the foregoing reasons, I must respectfully refuse to <br />approve the ordinance which is returned to you herewith. <br />Very truly yours, <br />CITY OF NORTH OLMSTED~ <br />C~.:`"~ <br />Ralp E.
