CHRISTMAN
Mayor
June 4, 1970
Council of the City of North Olmsted
City Hall
North Olmsted, Ohio
Dear Sirs;
~ ~ ~ h
Phone: 777-8000
This is to advise you that I have disapproved and vetoed
Ordinance No. 70-93, passed June 2nd, 1970.
I fully recognize that a municipal swimm~ing pool is needed
in this City but I cannot let this need influence my judgment as the
chief executive officer of the City responsible for the administration
of the City's affairs. This responsibility requires me to look at all
aspects of the City's operations and not just the need for a particular
facility.
I am concerned that the City's obligation under the lease.
agreement authorized by the ordinance may constitute an indebtedness
which would cause the City to exceed the 11.1 mill limitation established
by the Charter of the City. In addition the obligation to pay at least
$335,000 over the ten year lease period may contribute a debt for
purposes of the statutory debt limitations applicable to the City and the
City has not followed the provisions of the Uniform Bond Law, Chapter 133,
Ohio Revised Code, with respect to the obligation under the lease
agreement.
I also question whether the City can convey real estate as
provided for in the deed without competitive bidding and whether the
arrangement under which Community Recreation Company would construct a
swiuaming pool and lease it to the City would be a violation of the
competitive bidding requirements of the Charter. The lease agreement may
also constitute a contract which requires a certification under Section-
5705.41, Revised Code, and the Finance Director is not in a position to
execute such a certificate with respect to total obligation of the City
under the lease agreement.
For the foregoing reasons, I must respectfully refuse to
approve the ordinance which is returned to you herewith.
Very truly yours,
CITY OF NORTH OLMSTED~
C~.:`"~
Ralp E. Christman, Mayor
REC/ds
