-° <br />•~ , •a; <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. ~ ° ~,~ <br /> <br />AN ORDII~AiVCE AUTHORIZII~ E[~'IAYM'ENr OF EXPERTS <br />FOR ~IiE Ptk~POSE OF D1~VEIAP A PRtX~~iAM TO PRO- <br />VIDE HOSPITAL CARE TO RESTDEAITS OF CITY, AND <br />DECLARIl~ AN F.~MERGENCY. <br />WHEREAS, the Council of this City believes that it is necessary that <br />the City construct a general hospital within the limits of this municipal <br />corporation in order to provide more convenient hospital care. for the ordinary <br />illness oP its residents requiring hospitalization and more prompt care for <br />its residents in emergency situations; and <br />WHEREAS, the Council of the City now believes that the costs of pro- <br />viding such Hospital should be paid by the users of the Hospital's services; <br />and <br />WHEREAS, in furtherance of such belief, it is necessary to establish <br />the program which will construct and make available to the City's residents general <br />hospital facilities (such facilities resulting, from such program bei~ hereinafter <br />referred to as the "Hospital") including coordiaatfon of the activities to be u~tder- <br />taken, surveys of need, architectural and engineering services, necessary econo~aic <br />feasibility s#axdies, band counsel for legal advice with respect to financing, <br />underxriters for the City's revenue bonds and an option on a site, all to the end <br />that the expenses and use of the Hospital can be projected; <br />~ ~, BE IT ORIlAINED Bj~ the Council of the City of North <br />03.s~sted, County cf Ct~ahcga and Stets of Ohio: <br />Section 1. That the Me~yor be and he is hereby authorized and directed <br />to enter into an agre~at on behalf of the City with Ross Garrett doing business <br />as Ross Garrett 8s Associates, to prepare a program for providing to the City the <br />Hospital, cocardiaeat ~ the i~lementation of-such prograffi and assisting in the <br />activationaf such ~aspital when comstructsd. Such contract shall be in sub- <br />stantially the form ~w ~ file in the office of the Mayor and a~ is approved by <br />the Director c-P Law dad shall provide for payment of a fee of $5,000.00 at time <br />of exeeutic~wa cif tie cramtrsat ~s a r+~tainer a~ui shall provide, that if the City's <br />revemtte bonds are issued to finance construction of the Hospital, for. payment <br />from tie proceeds of the City's revenue bonds of an additional fee of (i) <br />$167,OOQ.00 payable at the tix+e of issuance of such bonds, and (ii) $43,000.00 <br />payable in ®gew.1. mantl~].y patents concing with the first day of the. <br />calendar rth iMSaediately following coe~encement of construction of the Hospital. <br />Section 2. That the Director of Law be and he is hereby authorized <br />to es~loy th,e law fix+m Qf Squire, Sanders & Dempsey, Cleveland, Ohio, as bond <br />cou~eeel iA -coma~eation Ni'F~t the development of the aforesaid program and financing <br />at~d! stltcb f~r~t shall be paid ~ua~t amd reasonable compensation far its services, <br />pravde~l, ba~eever, that it' revenue bonds of the City are not issued for the <br />purpose of Constructing the Hospital, then such compensation shall not exceed <br />1, f~0. Q0. <br />Section 3. That the Mayor be and he is hereby authorized and directed <br />to enter into option agreements giving to the City an opportunity to purchase as <br />a site for the Hospital that real estate bearing Permanent Parcel Numbers 233-7-7, <br />
