<br />Cl'.PY OF NORTH OLI~STED <br />ORDINAI~E NO. <br />BY ~~ .,,.~,~,.~--" <br />.,, <br />AN ORDINANCE TO APPROPRIATE THE FEE SIMPLE <br />INTEREST IN CERTAIN DESCRIBED REAL ESTATE FOR <br />THE OPEC OF AN EXTENSION OF BROOKPARK ROAD,. <br />AND DEGLARINr AN E[~tGENCY. <br />WHEREAS, on the 4th day of September, 1973, this Council <br />adopted Resolution No. 73-114 declaring the necessity and intention <br />of appropriating certain land hereinafter described necessary to the <br />extension of Brookpark Road, and notice of the adoption of such reso- <br />lution has been served on the owner, persons in possession and persons <br />having an interest of record in the property to be appropriated; and <br />WI~REAS, the City and the owners of the property to be <br />appropriated are still unable to agree as to the amount to be paid <br />by the City for such land; <br />NOW THEREFORE, BE IT ORDAINED by the Council of the City of <br />North 07msted, Cuyahoga County, Ohio: <br />Section l,. There is hereby appropriated for the public use <br />and public welfare for the purpose of opening as a public street an <br />extension of Brookpark Road, the fee simple interest, exclusive of the <br />owner's right of ingress to and egress from his abutting property, in <br />the following described real estate: <br />Situated in the City of North Olmsted, County of C~ahoga <br />and State of Ohio aril known as being part of Original Dover <br />Township, Lot No. 6 and part of Original Olmsted Township, Lot <br />No. 22, Tract No. 6 and bounded and described as follows: <br />ComQnencing in the intersection of the center line of <br />Brookpark Road (160 feet wide) with the center line of Lorain <br />Road (80 feet wide); Thence South 68° 13' 23" West a distance <br />of 88.64 feet to an iron pin at the point of intersection of <br />a curve connecting the old center line with the new center <br />line of Lorain Road; Thence South 65° 59' 43" West along a <br />tangent a distance of 73.53 feet to the place of beginning; <br />Thence North 13° 09' 46" West along the Westerly line of a <br />parcel of land conveyed to The Marathon Finance Companpr by <br />deed as recorded in Volume 10313, Page 405 of Cuyahoga County <br />Deed Records a distance of 200.72 feet to a point; Thence <br />South 68° 00' 33" West along the prolongation of Northerly <br />line of said The Marathon Finance Company parcel a distance <br />of 32.98 feet to a point of.curvature; Thence 248.81 feet <br />along the arc of a curve deflecting to the left and having a <br />radius of 440.00 feet, a chord distance of 245.50 feet that <br />bears North 50° 2g" 34" West to a point in the Easterly line <br />of a parcel of land conveyed to The Capital National Bank by <br />deed as recorded in Volume 11845, Page 57 of Cuyahoga County <br />Deed Records; Thence South 8° 55' 10" East along the Easterly <br />line of said The Capital National Bank parcel, a distance of <br />91.90 feet to an angle point; Thence North 71° 32' 27" East <br />a distance of 11.54 feet to an angle point; Thence South 18° <br />17' 09" East along the Easterly line of said The Capital <br />National Bank parcel a distance of 23.33 feet to a point of <br />curvature; Thence 217.67 feet along the arc of a curve de- <br />flecting to the right and having a radius of 360,00 feet, a <br />
