Andreano, Ohio Regis- <br />tered Surveyor No. 5194, be the same more or less, but subject <br />to all legal highways. <br />Section 2. The appropriation provided for in Section 1 hereof <br />ishereby directed to proceed and the Director of Law of this City and <br />Merkel, Campbell, Di11 & Zetzer, special counsel for the City, are hereby <br />authorized and directed to comaaence proceedings for such appropriation <br />from the owner and arty other persons, associations, corporations or <br />goverrniental agencies having ax~y right, title or interest of record in <br />such property, by filing a petition for such appropriation in a proper <br />court in accordance with Section 163.05 of the Revised Code, and this <br />Council, finding and determining that the City of North Olmsted qualifies <br />pursuant to the provisions of Section 19 of Article I of the Ohio <br />Constitution to appropriate private property for the public use and <br />public welfare that the private property hereby appropriated is for <br />the purpose of maki~ag roads which shall be open to the public without <br />charge, and that, immediate possession of the land described herein is <br />required, further authorizes and directs such attorneys to file with <br />such petition a declaration of intention to obtain possession of the <br />land described herein and to cause to be deposited with the court at <br />the time of the filing of such petition and declaration of intention <br />the value of the property and rights appropriated together with the <br />damages, if any, to the residue, which this Council finds and determines <br />to be in the amount of $ ~~fip. and such amount is hereby authorized <br />to be expended for such purpose and is hereby appropriated for such <br />purpose from the proceeds of bond anticipation notes to be issued for <br />such purpose. <br />Section 3. The other costs and expenses of said appropriation <br />are hereby directed to be paid out of the appropriate funds. <br />Section 4. That this ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the public <br />peace, health and safety and for the further reason that immediate opening <br />of the aforesaid extension of Brookpark Road is urgently required to <br />promote the free flow of traffic, afford adequate police and fire protection <br />and facilitate the prompt installation of required public improvements; <br />wherefore, this ordinance shall be in Hill force and. effect from and <br />immediately after its passage and approval by the Mayor. <br />Passed: ~ ~/~~~7.3 <br />Attest; G/I~.t~/, ~~'-~'c_. <br />Nora T.
