~. 4 CITY OF NORTH OLMSTED ORDINANCE NO. 73- ~Q/ BY: AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO THE FIRST SUPPLEMENTAL AGREE- MENT TO THE CONTRACT PREVIOUSLY ENTERED INTO APRIL 15, 1965, AND DECLARING AN EMERGENCY. WHEREAS, the City and the County on April 15 , 19 65 duly entered into an Agreement provided for the City to accept, receive, transport and dispose of sanitary sewage and wastes originating in an area set forth in Exhibit A of the Agreement ;and WHEREAS, newly enacted water quality guidelines for the drainage area of the City and County areas required the City to construct improvements at the City's waste water treatemert facilities to provide higher degree of treatment and nutrient removal ;and WHEREAS, the cost of these improvements including the increased cost~of operation and maintenance of these new facilities has been al+tacicated to the various entities being served by the City's treatment facilities and the allocation to the County for the area being served requires that rates and charges be increased ;and WHEREAS, the Commissioners of Cuyahoga County ,the Mayor and the Council of the City of North Ousted have agreed that the charges heretofore levied on users of the North Olmsted Sanitary Sewage Treatment Plant fn Olmsted Township must be increased. NOW, THEREFORE , BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That the Mayor of the City of North Olmsted is hereby authorized to enter into a contract with the Commissioners of Cuyahoga County, said contract being known as the First Supplemental Agreement to the contract entered into April 15, 1965 by the Board of County Commissioners for Cuyaga County and the City of North Olmsted, and to do everything necessary to put in force the conditions of the First Supplemental Agreernent,.which is attached hereto. Section 2. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, safety, health and welfare of the City of North Olmsted by virtue of the fact that said Agreement must be entered into immediately in order that the City of North Olmsted is not n~+quired to pay for the sewage treatment of users in Olmsted Township. WHEREFORE, this Ordinance shall take effect and be in force immediately upon its passage, otherwise, at the earliest period allowed by law. PASSED: ATTEST: ~ /~ `iad + ~ _ - Nora T.
