~. <br />4 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 73- ~Q/ <br />BY: <br />AN ORDINANCE AUTHORIZING THE MAYOR TO <br />ENTER INTO THE FIRST SUPPLEMENTAL AGREE- <br />MENT TO THE CONTRACT PREVIOUSLY ENTERED <br />INTO APRIL 15, 1965, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City and the County on April 15 , 19 65 duly entered into an <br />Agreement provided for the City to accept, receive, transport and dispose of sanitary <br />sewage and wastes originating in an area set forth in Exhibit A of the Agreement ;and <br />WHEREAS, newly enacted water quality guidelines for the drainage area of <br />the City and County areas required the City to construct improvements at the City's <br />waste water treatemert facilities to provide higher degree of treatment and nutrient <br />removal ;and <br />WHEREAS, the cost of these improvements including the increased cost~of <br />operation and maintenance of these new facilities has been al+tacicated to the various <br />entities being served by the City's treatment facilities and the allocation to the <br />County for the area being served requires that rates and charges be increased ;and <br />WHEREAS, the Commissioners of Cuyahoga County ,the Mayor and the <br />Council of the City of North Ousted have agreed that the charges heretofore levied <br />on users of the North Olmsted Sanitary Sewage Treatment Plant fn Olmsted Township <br />must be increased. <br />NOW, THEREFORE , BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That the Mayor of the City of North Olmsted is hereby authorized <br />to enter into a contract with the Commissioners of Cuyahoga County, said contract <br />being known as the First Supplemental Agreement to the contract entered into April <br />15, 1965 by the Board of County Commissioners for Cuyaga County and the City of <br />North Olmsted, and to do everything necessary to put in force the conditions of the <br />First Supplemental Agreernent,.which is attached hereto. <br />Section 2. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare of the City of North Olmsted by virtue of the fact that said <br />Agreement must be entered into immediately in order that the City of North Olmsted <br />is not n~+quired to pay for the sewage treatment of users in Olmsted Township. <br />WHEREFORE, this Ordinance shall take effect and be in force immediately upon <br />its passage, otherwise, at the earliest period allowed by law. <br />PASSED: <br />ATTEST: <br />~ /~ <br />`iad + ~ _ - <br />Nora T.
