<br />THIS FIRST SUPPLEMENTAL AGREEMEN'T' made and entered into thiso~

<br />duly authorized by a Resolution adopted by its Board of County

<br />W I T N E S S E T H:
<br />WHEREAS, the CITY and the COU~I'1'Y on April 15 1.965 duly entered
<br />.: "-
<br />into an Agreement provided for the CITY to accept; receive, transport `
<br />and dispose of sanitary sewage and wastes origina•Eing in an area set
<br />forth in Exhibit A of the Agreement; and
<br />WHEREAS, the Agreement provided that the CI1Y shall have the
<br />right, but not oftener than once within each fives year period from the ';
<br />-date of the Agreement (April 15, 1965), to establish with the approval
<br />''~of the COUNTY, a revised schedule'of rates and charges applicable to
<br />users of the County area sewer; and
<br />~ _
<br />WHEREAS, newly enacted water quality guidelines for the drainage
<br />area of the City and Count~~ areas required the CITY to construct "
<br />. ~ • improvements at the City°s wastewater treatment facil~''ies to. provide .
<br />~ , higher degree of treatment and nutrient removal;', and. ~ - •

<br />WHEREAS, the cost of these improvements including the increased
<br />~•`cost of operation and maintenance of these new facilities has been
<br />'allocated to the various entities being; served by the City~s treatment ,
<br />facilities and the allocation to the COUN'T'Y for the area*~eing served '
<br />requires that rates and charges be increased. ~ ,
<br />NOW, THEREFORE, the CITY an~,the COUNTY do hereby promise ands
