<br />AN ORDINANCE AMENDING SECTION 1711.01 OF
<br />THE NORTH OLMSTED FIRE PRE~tENTION CODE
<br />OF THE CITY OF FORTH OLMSTED, OHIO,
<br />( CODIFIED ORDINANCES) ENTITLED " COMPLI-
<br />ANCE REQUIRED "AND REPEALING SECTIONS
<br />1711.02 , 1711.03, 1711.04 and 1711.OS ,AND
<br />DECLARING AN EMERGENCY.
<br />WHEREAS, Council has determined that it is in the best interest of the City
<br />of North Olmsted that the North Olm " ,Fire Prevention Code be reviewed.
<br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North
<br />Olmsted ., State of Ohio :
<br />Section 1. That Section 1711.01 ,Chapter 1711 (Codified Ordinances) of
<br />the City of North Olmsted Fire Prevention Code reading as follows :
<br />1711.01 COMPLANCE REQUIRED.
<br />" No person sh~11 burn or set fire to any leaves, rubbish, paper
<br />or any other combustible material of any kind in any street, lane,
<br />lot, yard or any public or private ground in the City, except as
<br />provided in this Chapter. "
<br />be and the same shall read as follows :
<br />1711.01 COMPLIANCE REQUIRED.
<br />No person shall set any outdoor fire or burn out of doors any hay,
<br />straw, grass, weeds, wood, paper, garbage, refuse , trash or
<br />other combustible substances of any kind, excepting the use of
<br />outdoor grills used for cooking. Nor shall any person make any
<br />bonfire or other outdoor fire in any street, lot, yard, field lane,
<br />alley, or any private or public ground or in or on any lot or parcel
<br />of ground, excepting the use of outdoor grills used for cooking.
<br />The use of outdoor grills used for cooing is ~~ecifically excluded
<br />from the prohibitions contained in this section.
<br />Section 2. That this Section 1711.02, Chapter 1711 (Codified Ordinances )
<br />of the City of North Olmsted reading as follows is hereby repealed in its entirety
<br />1711.02 BURNING WITHIN CONTAINERS.
<br />" The owner or occupier of land may burn upon his own land leaves,
<br />paper or other refuse between sunrise and sunset, provided such
<br />leaves, paper or refuse are burned in a metal or suitable wire
<br />container, the open portions of which are no larger than one
<br />square inch. Such container shall have a solid metal cover thereon,
<br />or a wire or mesh cover, with openings which shall be nor larger
<br />than one square inch. Such container shall be placed not less than
<br />fifteen feet from any building or structure and attended by a
<br />competent person not less than fifteen years of age who must be
<br />continuously present while such fire is burning. Smoke, embers and
<br />ashes shall be confined to the premises of the owner or occupies
<br />of such lands, so as not to constitute a nuisance to adjoining,
<br />abutting or neighboring properties, lands or structures thereon. "
