ORDINA ~~NO. 73-41 <br />ORDINANCE OF THE <br />• CITY OF NORTH OLMSTED, ,OHIO <br />By Mr. <br />An ordinance by the City Council of the City of <br />North Olmsted, , Ohio, establishing a moratorium on the <br />acceptance o applications for the franchise of a cable tele- <br />vision system, and on the granting of a franchise for a cable <br />television system to operate within the corporate limits of <br />the City of North Olmsted, _ Ohio, and authorizing partici- <br />pation in a regional commission for cable television, <br />and authorizing the expert iture of funds from the city treasury <br />for the conducting of a study of cable television, and declaring <br />an emergency. <br />DEFINITION: CABLE TELEVISION SYSTEM <br />The term "cable television system" shall include the term <br />"community antennae television system" (CATV) and shall mean any <br />facility that (1) in whole or in part, receives directly or indi- <br />rectly over the air, and amplifies or otherwise modifies the sig- <br />nals transmitting programs broadcast by one or more television or <br />radio stations and distributes such signals by wire, cable or other <br />restricted radiation point to point means to subscribing members of <br />the public who pay for such service, whether such payment be made <br />separately or included as a part of any other payment, without re- <br />gard to the number of subscribers or the type of dwelling served, <br />or (2) combines reception of television or radio broadcast signals <br />together with originated programs or services. <br />WHEREAS, the City Council of the City of North Olmsted, <br />Ohio is desirous of obtaining information regar ing <br />t e various legal, technical and economic questions associated with <br />cable television so that it may, in the end result, obtain the best <br />possible cable television service for the residents of the City of <br />North Olmsted, , Ohio; and, <br />WHEREAS, it has been proposed that the various cities com- <br />prising the Greater Cleveland Area cooperate in a joint study of the <br />various legal, technical and economic questions associated with cable <br />television; and, <br />WHEREAS, the City Council of the City of North Olmsted, <br />Ohio recognizes that such a study, whether one in epen ently <br />or in conjunction with the other cities comprising the Greater Cleve- <br />land Area, will require a moratorium on the acceptance of applications <br />for, and on the granting of any franchise for a cable television sys- <br />tem, so that time may be afforded for such study, <br />WHEREAS, the City Council of the City of North Olmsted <br />Ohio recognizes that funds will be require or the con- <br />ucting-~ such a study, <br />WHEREAS, the Cleveland Associated Foundations have indicated <br />,an interest in providing matching funds for the aforementioned study, <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE <br />CITY OF North Olmsted, OHIO: <br />1. THAT, until further notice by this council, no application <br />for the grant of a franchise to build, construct. or operate a cable <br />television system within the corporate limits of the City of North <br />Olmsted ,Ohio will be accepted. <br />2. THAT, until further notice by this council, no franchise <br />to build, construct, or operate a cable television system within the <br />corporate limits of the City of North Olmsted Ohio <br /> <br />
