CITY OF NORTH OLMSTED <br />ORDINANCE NO. 68-197 <br />BY L,4-)_ <br />AN ORDINANCE CREATING SECTIONS 131.01 TO 131.04 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED BETIVG <br />AN ORDINANCE AUTHORIZING THE MAYOR TO DECLARE A STATE <br />OF EMERGENCY AIVD TO EXERCISE CERTAIN EMERGENCY POWERS <br />PURSUANT THERETO INCLUDING IMPOSITIONS OF A CURFEW, <br />PRESCRIBING THE PENALTY FOR THE VIOLATIONS OF ORDERS <br />ISSUED IN THE EXERCISE OF THE GRANTED POWERS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, certain municipalities, within and without Cuyahoga County, <br />have experienced riots and insurrections ;and <br />WHEREAS, during the riots it is necessary that the Mayor of a municipality <br />have the powers which are necessary to quell riots for the safety of citizens and <br />safety of their property ; and <br />WHEREAS, Council of the City of North Olmsted wishes the Mayor of the <br />City of North Olmsted to have such emergency powers necessary to declare a <br />state of emergency fn order to quell any riots or insurrections and to thereby <br />protect the residents of North Olmsted in their person and property. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />North Olmsted, Mtd,of Ohio : <br />Section 1. That Chapter 131 of the Administrative Code of the Codified <br />Ordinances of the City of North Olmsted, as revised, be and the same is here- <br />by amended by creating Section 131.01 to 131.04 to read as follows: <br />Section 131.01 Civil Emerctencv Powers of Mavor <br />Definitions <br />A. Civil Emergency is hereby defined to be : <br />( 1) A riot or unlawful. asserhialy characterized by the use of force or <br />violence or any threat to use such force by three or more person acting <br />together without the authority of law. <br />( 2) Any natural disaster or manmade cbamity including flood, conflagra- <br />tion, cyclone, tornado, earthquake or explosion within the corporate <br />limits of the City of IVorth Olmsted resulting or reasonably expected to <br />result in the death or injury of persons or the destruction of property to <br />such an extent that extra ordinary measures must be taken to protect the <br />publac health, safety and welfare. <br />B. Curfew is hereby defined as a prohibition against any person or persons <br />walking, running , loitering, standing or motoring upon any alley, street,
