?. <br />Amended <br />C ITY OF 1VORTH OLMSTED ORDINANCE IVO. 69-210 PAGE 2 <br />Section 2. That Ordinance IVo. 62-33, enacted June 19, 1962, Section <br />1125.62 entitled " Setback, " now reading as follows: <br />1125.62 Setback <br />" The minimum distance from the street line or front property <br />line to the -building line measured along a line perpendicular <br />to the street line or front property line, or in the case of an <br />are street, measuredirom the radius of such arc. " <br />be and the same is hereby amended to read as follows: <br />1125.62 Setback <br />The minimum distance from the street line or front property <br />line to the building line measured along a line perpendicular <br />to the street line or front property line, or in the case of an <br />are street, measured perpendicular to chord of the arc de- <br />scribing the front property line at its midpoint and measured <br />from the chord line or from the radius of the arc itself, which- <br />ever is greater. In the event one or more lots, or parcels of <br />land, which are adjoining, are used for the same use, or <br />accessory uses, the setback line shall extend and be the <br />same for all lots or parcels of land so used. <br />Section 3. That Ordinance No. 62-33, enacted June 19, 1962, Section <br />1133.10 entitled " IVotice, " now reading as follows: <br />I/ '?=?? , 0 <br />4?.0 Notice <br />" The Board shall not grant any variance from the provisions of <br />this Ordinance , affirm, reverse, or modify any ruling or de- <br />termination of the Building Official, make any requested <br />ruling or grant any special permit except after a public notice. <br />A notice of the date, time and subject matter of the public <br />hearing to be considered by the Board shall be given by first <br />class mail, postage prepaid, at least five ( 5) days prior to <br />the date of such hearing to the applicant or appellant and to <br />the independent record title owners of the following premises: <br />( A) Those on the same side of the street which abut the premises <br />involved, and <br />( B) Those on the same side of the street next contiguous to the <br />premises so abutting, and <br />( C) Those across the street immediately opposite the premises in- <br />volved and the premises opposite the abutting contiguous <br />properties described in ( A) and ( B) hereof, and <br />( D) Any other premises abutting the premises involved, and <br />( E) Such other premises as may be ordered to be notified by rule <br />or regulation of the Board or by its special order.
