CITY OF NORTH OLMSTED RESOLUTION NO. 69-1^1/ BY A RESOLUTION DECLARING THE INTENTION OF COUNCIL TO APPROPRIATE CERTAIN EASEMENTS, BOTH PERMAIVENT AND TEMPORARY, FOR THE CONSTRUCTION OF SEWERS, AND DECLARInTG AN EMERGENCY. WHEREAS, it is necessary in the judgment of this Council that immediate provisions be made for the construction, maintenance and opera- tion of certain sewers along, over and through certan property located in the City of North Olmsted, more fully hereinafter described, and WHEREAS, to provide in part the necessary rights of way required for such construction, maintenance and operation it is necessary in the opinion of this Council that easements, both permanent and temporary,for construction, operation and maintenance of said sewers be appropriated by the City of North Olmsted. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North Olmsted , State of Ohio: Section 1. That it is deemed necessary and it is hereby declared to be the intention of this Council to appropriate a right of way and ease- ment, both permanent and temporary, over, through and across the parcels of land described as follows: George R. Dancik and Dorothy Dancik, husband and wife, Permanent Parcel No. 233-8-15, both permanent and temporary. Situated in the City of North Olmsted, County of Cuyahoga and State of Ohio, and identified by Permanent Parcel No. 233-8-15, said land and premises having been acquired by deed dated October 17, 1959 and recorded in Volume 9768 , Page 595 of the Cuyahoga County Record of Deeds. The easement if further :described as being over and through a parcel of land sixteen ( 16 ) feet in width, the centerline of which begins at a point on the westerly line of Permanent Parcel No. 233- 8-15, this point being 399 feet in a northerly direction on the right- of-vvay line of Lorain Road ; thence in an easterly direction for a distance of 138 feet to a point on the easterly line of Permanent Parcel No.233-8-15, this point being 398 feet in a northerly direction from the right-of-way line of Lorain Road as shown on the attached drawing No. 76. A temporary easement over two parcels of land, each 30 feet in width and located parallel and adjacent to the above described permanent easement is hereby granted for the period of time re- quired to construct the sewer through this property. For the said purpose of constructing, maintaining, operating, re- pairing, altering, replacing, changing the size and removing a sewer together with the necessary manholes for the transportation of sewage with the right of unimpaired access to said sewer and the right of ingress and egress on, over and through said parcels of land for all purposes necessary and incidental
