.... .?.. ??. <br />.?• i ?!t. <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 69-1^1/ <br />BY <br />A RESOLUTION DECLARING THE INTENTION OF COUNCIL <br />TO APPROPRIATE CERTAIN EASEMENTS, BOTH PERMAIVENT <br />AND TEMPORARY, FOR THE CONSTRUCTION OF SEWERS, <br />AND DECLARInTG AN EMERGENCY. <br />WHEREAS, it is necessary in the judgment of this Council that <br />immediate provisions be made for the construction, maintenance and opera- <br />tion of certain sewers along, over and through certan property located in <br />the City of North Olmsted, more fully hereinafter described, and <br />WHEREAS, to provide in part the necessary rights of way required <br />for such construction, maintenance and operation it is necessary in the <br />opinion of this Council that easements, both permanent and temporary,for <br />construction, operation and maintenance of said sewers be appropriated <br />by the City of North Olmsted. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of North Olmsted , State of Ohio: <br />Section 1. That it is deemed necessary and it is hereby declared <br />to be the intention of this Council to appropriate a right of way and ease- <br />ment, both permanent and temporary, over, through and across the parcels <br />of land described as follows: <br />George R. Dancik and Dorothy Dancik, husband and wife, <br />Permanent Parcel No. 233-8-15, both permanent and temporary. <br />Situated in the City of North Olmsted, County of Cuyahoga and <br />State of Ohio, and identified by Permanent Parcel No. 233-8-15, <br />said land and premises having been acquired by deed dated <br />October 17, 1959 and recorded in Volume 9768 , <br />Page 595 of the Cuyahoga County Record of Deeds. <br />The easement if further :described as being over and through a <br />parcel of land sixteen ( 16 ) feet in width, the centerline of which <br />begins at a point on the westerly line of Permanent Parcel No. 233- <br />8-15, this point being 399 feet in a northerly direction on the right- <br />of-vvay line of Lorain Road ; thence in an easterly direction for a <br />distance of 138 feet to a point on the easterly line of Permanent <br />Parcel No.233-8-15, this point being 398 feet in a northerly <br />direction from the right-of-way line of Lorain Road as shown on the <br />attached drawing No. 76. <br />A temporary easement over two parcels of land, each 30 feet in <br />width and located parallel and adjacent to the above described <br />permanent easement is hereby granted for the period of time re- <br />quired to construct the sewer through this property. <br />For the said purpose of constructing, maintaining, operating, re- <br />pairing, altering, replacing, changing the size and removing a sewer together <br />with the necessary manholes for the transportation of sewage with the right of <br />unimpaired access to said sewer and the right of ingress and egress on, over <br />and through said parcels of land for all purposes necessary and incidental
