.? ? <br />CITY OF NORTH OLMSTED RESOLUTION NO. 69- PAGE 2 <br />to the construction, operation, maintenance, repair, altering, replacement, <br />changing the size and removal of said sewer. There shall be reserved to the <br />owners of the said parcels of land the right to fully use and enjoy said premises <br />for all purposes consistent with the full use and enjoyment by the City of the <br />easement rights herein described, but the construction of structures as defined <br />in the Building Code of the City of IVorth Olmsted directly over any said sewer, <br />except public utilities, is prohibited. It is a further condition on the said ease- <br />ment rights, that the City return the surface of the ground to its original level <br />and general condition after any of the construction-, maintenance, operation, <br />repair, replacement, alteration, changing the size of or removal of said sewer. <br />Section 2. That the Mayor be and he is hereby authorized and directed <br />to cause written notice of the passage of this Resolution to be given to the owners <br />of, or persons in possession of, or persons having an interest of record in the <br />above described real estate, or to their authorized agents and said notice shall <br />be served according to law by a person to be designated for that purpose by the <br />Mayor and to make return of such service in the manner provided by law. <br />Section 3. That the Director of Law be and he is hereby authorized <br />and directed to institute all necessary proceedings to acquire said easements, <br />as provided for in this Resolution. <br />Section 4. That this Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare of the City of North Olmsted, and for the further reason that <br />it is necessary to have this Resolution effective immediately in order that the <br />City may proceed with the construction of the sewer, thus contributing to the <br />greater health and confort of the inhabitants of this City.
