r <br />.+ • - w.? <br />i <br /> <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 69- aZ <br />BY- i? <br />A RESOLUTION DECLARING THE INTEIVTIOIV OF COUNCIL <br />TO APPROPRIATE CERTAIN PROPERTY FOR THE PURPOSE OF <br />ADDITIONAL RECREATION'AL AREAS FOR THE CITY OF NORTH <br />OLMSTED, AND DECLARING AIV EMERGENCY. <br />WHEREAS, it is necessary in the judgment of this Council that <br />immediate provisions be made for the construction, maintenance and <br />aquisition of certain property for the purpose of additional recreational <br />areas located in the City of North Olmsted which property is more fully <br />hereinafter described ; and <br />WHEREAS, to provide in part the additional recreational areas re- <br />quired, it is necessary in the opinion of this Council that said property be <br />appropriated by the City for recreational purposes. <br />WHEREAS, under Ordinance No. 68-89 Council authorized the Mayor <br />to negotiate for the purchase of certain portions of the land of Permanent <br />Parcel No.'s 234-22-22 and 234-22-23, and the Mayor,after, several attempts <br />to purchase said property, has been unable to purchase said property for the <br />appraised value, Council now deems it necessary to appropriate said pro- <br />perty for recreational purposes. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That it is deemed necessary and it is hereby declared to <br />be the intention of this Council to appropriate a certain portion of Permanent <br />Parcel No.'s 234-22-22 and 234-22-23, said portions of land to be appropriated <br />is described as follows: <br />Rear Portion- John P. Mariner and J. L. Mariner • <br />Permanent Parcel No. 234-22-22 <br />Situated in the City of North Olmsted, County of Cuyahoga and <br />State of Ohio, and known as being part of Original Olmsted Town- <br />ship Lot IVo. 10 in Tract No. 6, and bounded and described as follows: <br />Starting at a point in the center line of Steams Road ( 60 feet wide <br />distant southerly measured along said center line, 117.31 feet from <br />the intersection of said center line and the northerly line of land con- <br />veyed to Elijah Stearns, Jr. , by deed recorded in Volume 398, Page <br />78, of Cuyahoga County Records and Deeds ; thence South 89 ° 05' <br />40" east parallel with the northerly line of land so conveyed to <br />Eli jah Stearns, Jr. , a distance of 300. 00 feet to the point of be- <br />ginning ; thence continuing south 89° 05' 40" east a distance of <br />442. 79 feet to a point in the easterly line of said original Lot No. <br />10, in Tract No. 6; thence south 1° 09' 50" west , along the east- <br />erly line of said original Lot No. 10, a distance of 5 8. 64 feet ; thence <br />north 1° 16' east, parallel with the center line of Steams Road a dis- <br />tance of 5 8. 64 feet to the place of beginning, and containing 0. 5 8 <br />acre of land, be the same more or less, but subject to all legal high - <br />ways.
