? .ook Revised <br />? <br />CITY OF NORTH OLMS'IED <br />ORDINANCE NO. 69-34 <br />BY WEST <br />AN ORDINANCE LIMITING THE ACCUMULATION OF <br />OVERTIME, AND VACATION AND/OR HOLIDAY TIME <br />FOR MEMBERS OF THE POLICE DEPARTMEIV"T AND <br />FIRE DEPARTMENT. <br />WHEREAS, Council desires to control the number of hours and <br />days that may be accumulated by members of the Police Department and <br />Fire Department ; and <br />WHEREAS, it is the opinion of Council that any such member <br />accumulating more than eighty ( 80 ) hours of overtime shall be paid for <br />such time ;and <br />WHEREAS, it is also the opinion of this Council that the members <br />of such departments should be required to use the days granted to them for <br />vacation period and holidays within a specified time. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of North Olmsted, State of Ohio : <br />Section 1. That on January 15, April 15, July 15 , and October 15, <br />of each year, each member of the Police Department and/or Fire Department, <br />of the City of North Olmsted, shall be paid for all overtime hours accumulated <br />in excess of 80 hours for the overtime accumulated for the 3 calendar xr?onth <br />period immediately prior to the above dates of january 15, April 15, July 15 , <br />and October 15. Any payment,as set forth above, shall be paid at the rate of <br />pay for the classification that it was earned at after applying the longevity <br />increment applicable to the particular employee of the Police and /or Fire <br />Department ,and payments shall include accumulated overtime and longevity <br />earned. <br />Section 2. That any member of the Police Department or Fire <br />Department being changed in rank shall be paicl immediately for all over- <br />time that he has accumulated and he shall commence the tenure of his new <br />rank with no accumulated overtime hours. Such pay shall be based upon the <br />classification that the member was in prior to his promotion. <br />Section 3. That the existing accumulated overtime will be paid <br />to the members of the Police Department and/or Fire Department over a <br />3 year period effective April 1, 1969. Upon termination of the employment <br />or death of any member of the Police and / or Fire Department the accumulated <br />overtime hours shall be paid to the employee terminating his employment, or <br />in the case of death, to the beneficiaries of the deceased employee as ..desig- <br />nated by law. <br />Section 4. A member of the Police Department or Fire Department <br />shall become eligible for his authorized vacation leave on the anniversary <br />date of his appointment to the Department and shall take such vacation leave <br />before the next anniversary date unless written permission is obtained from <br />the Director of Safety to carry over the vacation to the following year, in the <br />event of such written permission being granted by the Director, such member <br />may not carry such accumulated vacation leave past his next anniversary date. <br />Vacation leave not used within two ( 2) years of the anniversary date on which <br />it is earned will be lost to the credit of such member.
