? t ORDINANCE NO. 69-M 1 BY AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE CITY OF NORTH OLMSTED, OHIO, SECTION 337,10 ( CODIFIED ORDINANCE ), ENTITLED " LIGHTS OF $LOW MOVING VEHICLES, " TO CONFORM TO CHANGE3. ENACTED BY THE OHIO GENERAL ASSEMBLY, AND REPEALI4G ORDIN- ANCE NO. 65-298, SECTION 337.10 ( CODIFIED ORDINANCE AND DECLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any conflict with provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That Section 337.10, Chapter 337 ( Codified Ordinance ) of the City of North Olmsted Traffic Code reading as follows: 337.10 LIGHTS O1V SLOW-MOVING VEHICLES ; EMBLEM REQUIRED. ( a) All vehicles, including those referred to in Section 337.10 not specifically required to be equipped with lights by Section 337.02 to 337.09, inclusive, shall, at the time and under the circumstances specified in Section 337.02, display at least one lighted light or lantern exhibiting a white itight vfs'rble from a distance of approximately five hundred feet to the front of such vehicles and a light or lantern exhibiting a red light visible from a distance of approximately five hundred feet to the pear. ( b) All farm machinery and other macliinery, including all road construction machinery , except when being used in actual construction and maintenance work in an area guarded by a flagman, or where flares are used, or when operating or traveling within the limits of a construction area designated by the Ohio Director of Highways or the Municipal or County Engineer, when such eonstruction area is rziarked in aceordance with requirements of the Ohio Director of H#.ghways and the Ohio Manual of Uniform Traffic Control Devices, as set forth in Ohio R. C. 4511,09 , which is designed for operation at a speed of twenty-five miles an hour or less, shall dis- play a triangular slow- moving vehicle emblem (SMV ) during the time and under the circumstances specified in Section 337.02. Such emblem shall be mounted so as to be visible from a distance of not less than five hundred feet to the rear, The design and position of mounting the SMV emblem shall be as provided by the Ohio Director of Highway Safety. ( c 1 The use of this emblem shall be restricted to the slow-moving vehicles specified in subsections ( b) and ( f) of this section, and its use on any other type of vehicle or stationary objects on'the street or h3ghway is prohibited.
