i? <br />. ? <br />ti <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 69-65 <br />BY <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE <br />CITY OF NORTH OLMSTED, OHIO, SECTION 331.19 <br />(CODIFIED ORDINANCE), ENTITLED "RIGHT OF WAY OF <br />EMERGENCY VEHICLE," TO CONFORM TO CHANGES EN- <br />ACTED BY THE OHIO GENERAL ASSEMBLY, AND DECLAR- <br />ING AN EMERGENCY. " <br />WHEREAS, Council has determined that it is in the best <br />interest of the City of North Olmsted that the North Olmsted Traffic <br />Code be reviewed to eliminate any conflicts with provisions of the <br />State Statutes, as enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of North Olmsted, State of Ohio: <br />Section l. That Section 331.19, Chapter 331 (Codified <br />Ordinance) of the North Olmsted Traffic Code reading as follows: <br />331.19 RIGHT OF WAY OF EMERGENCY VEHICLE. <br />"(a) Upon the approach of an emergency vehicle, <br />equipped with at least one flashing red light <br />visible under normal atmospheric conditions from <br />a distance of five hundred feet to the front of <br />such vehicle, and the driver's giving audible <br />signal by siren, exhaust whistle, or bell, the <br />driver of every other vehicle shall yield the <br />right of way, immediately drive to a position <br />parallel to, and as close as possible to, the <br />edge or curb of the street clear of any intersec- <br />tion, and stop and remain in such position until <br />the emergency vehicle has passed, except when <br />otherwise directed by a police officer. <br />"(b) This section does not relieve the driver <br />of an emergency vehicle from the duty to drive with <br />due regard for the safety of all persons and property <br />upon the street." <br />be and the same is hereby amended to read as follows: <br />331.19 RIGHT OF WAY OF PUBLIC SAFETY VEHICLE. <br />Upon the approach of a public safety vehicle, equipped <br />with at least one flashing, rotating or oscillating <br />light visible under normal atmospheric conditions from <br />a distance of 500 feet to the front of such vehicle and <br />the driver is giving audible signal by siren, exhaust <br />whistle or bell, the driver of every vehicle shall yield <br />the right of way, immediately drive to a position parallel <br />to and as close as possible to, the right edge or curb of <br />the street clear of any intersection, and stop and remain <br />in such position untiil the public safety vehicle has passed, <br />except when otherwise directed by a police officer.
