of <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 69-70 <br />BY <br />?--?- <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE <br />CITY OF NORTH OLMSTED, OHIO, SECTION 333.02 <br />(CODIFIED ORDINANCE), ENTITLED "RECKLESS OPERATION <br />ON THE STREET, PUBLIC OR PRIVATE PROPERTY," TO CON- <br />FORM TO CHANGES ENACTED BY THE OHIO GENERAL ASSEM- <br />BLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best <br />interest of the City of North Olmsted that the North Olmsted Traffic <br />Code be reviewed to eliminate any conflicts with provisions of the <br />State Statutes, as enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of North Olmsted, State of Ohio: <br />Section l. That Section 333.02, Chapter 333 (Codified <br />Ordinance) of the North Olmsted Traffic Code reading as follows: <br />333.02 RECKLESS OPERATION ON STREETS, <br />PUBLIC OR PRIVATE PROPERTY. <br />"(a) No person shall operate a vehicle without <br />due regard for the safety and rights of <br />pedestrians and drivers and occupants of <br />all other vehicles so as to endanger the <br />life, limb, or property of any person while <br />in the lawful use of the streets or highways. <br />"(b) No person shall operate a vehicle, without <br />due regard for the safety and rights of ped- <br />estrians and drivers and occupants of all <br />other vehicles so as to endanger the life, <br />limb, or property of any person while in the <br />lawful use of any public or private property <br />other than streets or highways. <br />This subsection does not apply to the competitive <br />operation of vehicles on public or private pro- <br />perty when the owner of such property knowingly <br />permits such operation thereon." <br />be and the same is hereby amended to read as follows: <br />333.02 RECKLESS OPERATION ON STREETS, <br />PUBLIC OR PRIVATE Pi20PERTY. <br />(a) No person shall operate a vehicle on any <br />street or highway without due regard for the <br />safety of persons or property.
