(d) Regular full-time employees within the <br />classification affected who have <br />completed their probationary period; <br />(e) In the application of the foregoing, <br />employees will be retained by reason of <br />their seniority only if they are able <br />to perform the available work. <br />41. Regular full-time employees shall be laid off on the <br />basis of their seniority within their classification. When <br />the seniority or service of two or more employees is equal, <br />employees shall be laid off by the drawing of lots. In the <br />event an employee cannot hold his present classification, he <br />shall have the right to "bump" an employee with lesser <br />seniority in an equal or lower rated classification within the <br />City, provided the employee has the ability to do the work of <br />the classification. <br />42. Whenever practicable, a regular full-time employee shall <br />be given a minimum of two (2) weeks advance notice of a lay- <br />off for lack of work. <br />43. In the event an employee is laid off for lack of work, <br />he shall receive payment for any earned but unused vacation as <br />quickly as practicable, but no later than fourteen (14) calendar <br />days after the lay-off. <br />-23-
