. <br />- - 2 - <br />NOW, THEREFORE, for valuable consideration, the receipt <br />and legal sufficiency of which are hereby acknowledged, the parties <br />agree: <br />(1) Great Northern, at Great Northern's sole cost and <br />expense, shall have prepared plans, specifications and estimates <br />of cost approved by the City and the Cleveland Electric Illuminating <br />Company for the roadway illumination of Country Club Boulevard from <br />Great Northern Boulevard to 1,200 feet west of the intersection. <br />(2) The plans shall include high-pressure sodium luminaires <br />mounted on galvanized steel poles and underground wiring to provide <br />an average of 1.5 horizontal foot-candles with a uniformity ratio <br />of 3 to 1. <br />(3) Great Northern, at Great Northern's sole cost and <br />expense, and in accordance with the plans and specifications, <br />approved by the City and the Cleveland Electric Illuminating <br />Company, shall cause to be installed the roadway illumination <br />and s.hall assign to the City such warranties as Great Northern <br />shall receive from manufacturers and/or contractors with respect <br />to said roadway illumination and installation. <br />(4) Upon completion of installation of said roadway <br />illumination and inspection and acceptance by the City, said <br />roadway illumination on Country Club Boulevard shall, after <br />January 1, 1982, be and remain the sole property of the City; <br />and thereafter the City, at the City's sole cost and expense, <br />shall be responsible for the repair and maintenance of the street <br />illumination. <br />(5) Great Northern shall indemnify, save and hold <br />harmless, the City from payment of any and all costs incurred <br />in connection with the installation of said street illumination. <br />(6) Great Northern shall comply with all City <br />ordinances and the Ohio Manual of Uniform Traffic Control Devices <br />in regard to the installation of the street illumination.
