CITY OF NORTH OLb4STED <br />ORDINANCE N0. 81- 105 <br />PAGE 4. <br />755.09 TAGGING OF ARTICLES. <br />Every dealer licensed under the provisions of this Chapter <br />shall, at the time of making any purchase, attach a tag with <br />a dessgnating number thereon, legibly written in I:nglish to <br />each secondhand article purchased, and shall make an entry of <br />such number in the book provided for in Section 755.07. <br />755.10 CfIANGE OR REMOVAL OF ARTICLES. <br />No person licensed under the provisions of this Chapter shall <br />di.sassemble, take apart, change the form of, sell or remove <br />from his place of business any of the secondhand goods, articles <br />or things sold to him, which are set forth in Section 755.02, <br />until the same have been in his possession at least thirty days, <br />or any of the secondhand goads, articles or things sold to him, <br />as set forth in Section 755.01, until the same have been in his <br />possession at least ten (10) days. <br />755.11 HOURS AND CIRCUMSTANCES OF SALES. <br />(a) No person licensed under the provisions of this Chapter <br />shall purchase any secondhand goods, article or things from any <br />pcrson who is at thc timc intoxicated, from an habitual clrunkarcl, <br />from any person knowii by him to be a thief or an associate of <br />thieves, from any receiver of stolen property or from any person <br />he has reason to suspect to be such. <br />(b) No person shall accept listings or receive by sale, <br />barter, exchange or otherwise any article mentioned in this Chapter <br />from a minor under the age of eighteen (18) years, knowing or <br />having reason to believe him to be such, or from any person between <br />the hours of 7:00 P.M. and 8:00 A.M. of the following day on <br />every day of the week except Saturday, and between the hours of <br />9:00 P.M. and 8:00 A.M. of the following day of Saturday and on <br />days before legal holidays. <br />755.12 EXCEPTIONS. <br />This Chapter shall not apply to persons who deal exclusively <br />in furniture, nor to persuns who deal exclusively in secondhand <br />automobiles, nor to any person who is engaged in the business of <br />a pawnbroker and who lias complied with the provisions of law and <br />the ordinances of the City with respect to the conduct of such <br />pawnbroking business. Nothing contained in this Chapter shall <br />be construed to apply to pianos, books, magazines, rugs, tapestries, <br />burlaps, paintings drawing s, etchings and engravings. Shall not <br />apply to the casuaj sales between persons at such sales as "garage", <br />"basement", and "yard". <br />755.99 PENALTY. <br />Whoever violates any provision of this Chapter shall be guilty of <br />a first degree misdemeanor and shall be fined not more than $1,000.00 <br />and/or imprisoned for not more than six (6) months. In addition <br />to any fine and costs, the license herein provided for shall be <br />revoked for a period of no less than six (6) months nor more than <br />one year.
