SARINGER <br />AN ORDINANCE ESTABLISHING A NEW CHAPTER WITHIN <br />THE GENERAL OFFENSES CODE OF THE CODIFIED ORDINANCES <br />OF THE CITY OF NORTH OLMSTED TO BE KNOWN AS CHAPTER <br />557 ENTITLED "SALE OF CIGARETTES AND TOBACCO PRODUCTS <br />TO MINORS". <br />WHEREAS, this Council deems it in the best interest of <br />the citizens of the City of North Olmsted, together with the general <br />health, safety, and welfare of minors to limit and prohibit the sale <br />of tobacco products to minors. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there is hereby created a new chapter <br />within the eneral Offenses Code of the Codified Ordinances of the <br />City of North Olmsted, which new chapter shall be known as "Sale <br />of Cigarettes and Tobacco Products to Minors", which new chapter <br />shall read as follows: <br />CHAPTER 557 <br />SALE OF CIGARETTES AND TOBACCO PRODUCTS TO MINORS <br />557.01 DEFINITIONS <br />(a) Cigarettes include any roll for smoking made <br />wholly or in part of tabacco, irrespective of <br />size or shape, and whether or not such tobacco <br />is flavored, adulterated, or mixed with any <br />other ingredient, the wrapper or cover of which <br />is made o£ paper, reconstituted cigarette tobacco, <br />homogenized cigarette tobacco, cigarette tobacco <br />sheet, or any similar materials. <br />(b) Tobacco products include the proceeds, yield or <br />final form of anything made up wholly or in part <br />of genus of plant known as "Nicotiana". Such <br />products include but are not limited to cigars, <br />pipe tobacco, chewing tobacco and snuff. <br />557.02 SALES OF CIGARETTES OR TOBACCO PRODUCTS TO MINORS: <br />PROHIBITIONS AND MISREPRF.SENTATIONS <br />(a) No person shall sell cigarettes or tobacco <br />products to a person under the age of eighteen <br />(18) years, or buy cigarettes or tobacco products <br />for, or furnish such material to, a person under <br />the age of eighteen (_18) years, unless such is <br />done by a parent or legal guardian. <br />(b) No person under the age of eighteen (18) years <br />shall purchase cigarettes or tobacco products. <br />(e) No person under the age of eighteen (18) years <br />shall order, pay for, share the cost of, or attempt <br />to purchase cigarettes or any tobacco product <br />except as! provided in subsection (a) hereof.
