<br />. ? - <br /> ? <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81- 44 <br />BY: RONALD WILAMOSKY <br />AN ORDINANCE AMENDING SECTION 1353.12 OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED "MAINTAINING GR.ADE LINES ESTABLISHED BY <br />CITY: PERMIT AND DEPOSIT REQUIRED" OF CHAPTER <br />1353 ENTITLED "GRADING AND SURFACE WATER DRAINAGE". <br />WHEREAS, this Council has reviewed the fees rec{uired to be <br />paid with respect to engineering costs regarding grade lines, and <br />WHEREAS, it has been determined that the present fee structure <br />is inappropriate and must be updated. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 1353.12 entitled "Maintaining Grade <br />Lines Establis e by City; Permit and Deposit Required" of the <br />Codified Ordinances of the City of North Olmsted which now reads <br />as follows: <br />"1353.12 MAINTAINING GRADE LINES ESTABLISHED BY CI,TY; <br />PERMIT AND DEPOSIT REQUIRED. <br />When the City Engineer has set and finally determined and <br />established the finished grade line of any paxcel of xeal estate, lot <br />or land within the City, thus providing for the drain age of surface <br />water therefrom, the owner, occupant or any oth.er person in charge of <br />such premises shall continue to maintain and adhere to such finished <br />grade line of such premises and shall further keep all drains, ditches, <br />swales or other surface water conductors open, free and clear of any <br />and all obstructions. <br />Any builder, contractor, landscaper or owner doing any grading, <br />regrading, landscaping or sodding or performing any other work affecting <br />drainage of any parcel of land in the City shall, prior to doing any <br />such work, obtain from the City Engineer a permit to perfoxm such work. <br />Such person shall furnish a plan of the parcel of land upon which the <br />work is to be performed. The plan shall show all data necessary to <br />determine the extent and character of the work to be done and its <br />effect upon drainage. As a condition for issuance of a permit for <br />grading, regrading, landscaping, sodding and other such work, the <br />person performing sych work shall deposit with the City Engineer the sum <br />of fifty dollars ($50.00). <br />Sucli deposit shall be used for checking of plans, establishing <br />finished grades, where necessary, and inspection and/or surveys. Costs <br />shall be calculated at twenty dollars ($20.00) per hour for the City <br />Engineer, thirty dollars ($30.00) per hour for the survey crew and <br />eleven dollars and fifty cents ($11.50) per hour for inspection. <br />If work does not conform to the approved plans and the deficiencies <br />are not corrected within fifteen days after reauest by the City <br />Engineer, then the City Engineer shall cause the deficiencies to be <br />corrected as provided in Sections 1353.13 and 1353.14. When the work <br />has been completed, inspected and approved by the City Engineer, what- <br />ever balance remaining in the deposit may be refunded. <br />(Ord. 77-64. Passed 5-3-77.)"
