k <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81- 32 <br />BY : p? <br />XI <br />^ (? <br />'1I <br />? <br />` <br />AN ORDINANCE PROVIDING FOR THE SUBAIISSION <br />TO THE ELECTORS OF THE CITY OF NORTH OLMSTED <br />A PROPOSED AMENDMENT TO THE CHARTER OF THE <br />CITY OF NORTH OLMSTED RELATING TO THE ELIMINA- <br />TION OF THE REOUIREMENT THAT THE DIRECTOR OF <br />FINANCE BE REQIJIRED TO SERVE ON A FULL-TIME <br />BASIS, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the Charter of the City of North Olmsted <br />and the Constitution of the State of Ohio, this Council has deter- <br />mined to authorize and direct the submission to the electors of <br />the City of North Olmsted of a proposed Charter amendment herein- <br />after set forth at the Primary Election to be held on June 2, 1981, <br />which election is not less than sixty (60) days nor more than <br />one hundred twenty (120) days from the date of the passage of this <br />ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: TWO-THIRDS <br />OF COUNCIL CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs <br />the submission to the electors of the City of North Olmsted at <br />the Primary Election to be held at the usual places of voting in <br />said City on Tuesday, June 2, 1981, the following proposal to <br />amend the Charter of the City of North Olmsted: <br />Proposal: That Article V, Section 3 of the Charter be amended <br />to provi e t at the Director of Finance not be reauired to serve in <br />that position on a full-time basis, such amended Section 3 of <br />Article V to read as follows: <br />ARTICLE V <br />ADMINISTRATIVE OFFICERS AND DEPARTMENTS <br />SEC. DIRECTOR OF FINANCE. <br />The Director of Finance shall conduct the business of his <br />office from the Municipal Building, and shall be the head of the <br />Finance Department and the Fiscal Officer of the City. Commencing <br />with the regular municipal election in the Year 1977, and every fourth <br />(4th) year thereafter, he shall be elected for a term of four (4) <br />years. His term shall begin and he shall assume office on the first <br />day of January next following such election. No person shall be <br />eligible to be the Director of Finance unless he shall have been a <br />qualfied elector and resident of the City for at least two (2) years <br />immediately prior to the date of his election, and shall continue <br />to be a qualified elector and resident of the City during his term <br />of office. The Director of Finance shall at the time of his election <br />be either a certified public accountant or a registered public <br />accountant with a minimum of five (5) years public or private <br />accounting experience immediately preceding his election. <br />In the event the office of Director of Finance shall become <br />vacant for any reason, the Mayor shall appoint a successor, subject <br />to confirmation by a majority of the members of Council, to serve <br />for the unexpired term or until the election of a successor for the <br />unexpired term at the next regular municipal election provided that, <br />(a) such election shall occur more than two (2) years prior to the <br />expiration of the unexpired term, and (b) the vacancy shall have <br />occurred more than seventy five (75) days prior to the date for the <br />primary election.
