<br /> <br />However, said Lessor agrees and understands that said <br />Lessee shall not hereby be liable for nor chargeable with <br />any income tax, inheritance, succession, estate, excess <br />profit, corporation or capital levy tax, or tax of a similar <br />nature, which said Lessor may be called upon to pay on <br />account of Lessor's ownership of the real estate; provided, <br />however, that in any case in which a tax may be levied, <br />assessed or imposed upon the income arising from the rent <br />hereunder for the use and occupancy of the demised real <br />estate and improvements thereon in lieu of a real estate tax <br />upon the same, or if at any time during the term.of this <br />lease the method of taxation prevailing at the commencement <br />of the term hereof shall be altered so as to cause the whole <br />or any part of the taxes, assessments, levies, impositions <br />or charges now or hereafter levied, assessed or imposed on <br />the real estate and the improvements thereon, to be levied, <br />assessed or imposed wholly or partially as a capital levy or <br />, <br />otherwise on the rents therefrom in lieu of a real estate <br />tax upon the same, Lessee sha11 upon written request by <br />Lessor reimburse the same to Lesssor. However, Lessee's <br />obligation hereunder shall be limited to the amount of the <br />newly imposed taxes in lieu of real estate taxes solely to <br />the extent that the Lessor would be taxed if this were the <br />sole piece of real estate owned by Lessor. <br />6. Evidence Showing Payment of Taxes. Upon written <br />application of said Lessor, said Lessee shall furnish to <br />said Lessor written evidence that all of the above <br />enumerated taxes and assessments and other charges have been <br />paid. In the event that said Lessee shall fail to pay any <br />of the above enumerated taxes and assessments and other <br />charges, said Lessor may pay the same, which shall be <br />/ <br />- 5 -
