<br />r <br />procedures provided herein, free from any interference, coercion, <br />restraint, discrimination or reprisal. A IdOTEA representative shall have <br />the right to be present at all stages of the Grievance Procedure. It <br />is the intent and purpose of the parties to this Agreement that all grievances <br />shall be settled, if possible, at the io~~7est stomp of this proc_d~_:re. <br />Section 16.02. For the purposes of this procedure, the terns <br />listed below are defined as follows: <br />(a) Grievance - A "grievance" shall be defined as a disput;; <br />or controversy arising from the misapplication or <br />misinterpretation by the City of this Agreement, or the :ris- <br />application or misinterpretation by the City of any work <br />rule. <br />(b) Aggrieved Party - The "aggreived party" shall be defined as <br />only an employee or group of employees within the bargaining <br />unit actually filing a grievance. <br />(c) Day - A "day" as used in this procedure shall mean calendar <br />days, excluding Saturday, Sundays or Holidays as provided <br />fo:- in this Agreement. <br />Section 16.03. The following procedures shall apply to the handling <br />of all grievances filed under this procedure: <br />(a) All grievances shall include the name and position of the <br />aggrieved party; the provisions} or this Agreement or <br />work rule involved in the grievance; and a general statement <br />of the nature of the grievance and the redress sought by <br />the aggrieved party. <br />(b) All decisions shall be rendered in writing at each step of <br />the grievance procedure. Each decision shall be transmitted <br />to the aggrieved party and the PIOTEA representative. <br />!c) Research and preparation of grievance filed by PdOTEA shall <br />be conducted during non-work hours where praticable. <br />Grievance meeting held with the appropriate Employer <br />representatives shall be during the nor_nal City business <br />day (8:30 AID: to 4:30 PM). A NOTEA representative rho had been <br />scheduled to work when the grievance meetings are held ~~ill be <br />rescheduled to meet current work schedules. The aggrieved party <br />shall have the right to no more than, two {2) representatives: <br />one (1) steward and one (1) representative of his classification. <br />(d) Alothing contained 1-ierein shall be construed as limitinct <br />the right of any employee having a grievance to discuss the <br />matter informally with the Service girector and having said <br />matter informally adjusted without the intervention of the <br />NOTEA, provided that the adjustment is not inconsistent <br />with the terms of this Agreement and does nct involve <br />interpretation of the Agreement. I:i the event that any grievan~.e <br />is adjusted without formal intervention pursuant to this <br />procedure, while such adjustment shall be binding upon the <br />aggrieved party and considered a final decision, said <br />8 <br />
