CITY OF NORTH OLMSTED <br />ORDINANCE N0. 89 - 68 <br />BY: COUNCILMAN BOEHMER <br />AN ORDINANCE AMENDING SECTION 371.06 (c) AND (d) OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED, <br />"USE OF HIGHWAY FOR SOLICITING; RIDING ON OUTSIDE OF <br />VEHICLES" OF CHAPTER 371 ENTITLED, "PEDESTRIANS". <br />WHEREAS, the present North Olmsted Codified Ordinances, Section <br />371.06 (c) and (d) do not prohibit the riding upon the outside of vehicles <br />upon private or public property used for vehicular traffic, and <br />WHEREAS, there have been several serious injuries caused by the <br />practice of riding on or permitting persons to ride on the outside of <br />vehicles on public or private property used for vehicular traffic, and <br />WHEREAS, there is a desire of council to make it unlawful to ride on <br />or permit persons to ride upon the outside of a vehicle on public or private <br />property used for vehicular traffic. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 371.06 (c) and (d) entitled "Use of Highway <br />For Soliciting; Riding on Outside of Vehicles" of Chapter 371 entitled <br />"Pedestrians", which now reads: <br />371.06 USE OF HIGHWAY FOR SOLICITING; RIDING ON OUTSIDE OF VEHICLES. <br />(a) No person while on a roadway outside a safety zone shall solicit <br />a ride from the driver of any vehicle. <br />(b) No person shall stand on a highway for the purpose of soliciting <br />employment, business or contributions from the occupant of any vehicle. <br />(c) No person shall hang onto, or ride on the outside of any motor <br />vehicle while it is moving upon a roadway, except mechanics or test <br />engineers making repairs or adjustments. (ORC 4511.51) <br />(d) No operator shall knowingly permit any person to hang onto, or <br />ride on the outside of any motor vehicle while it is moving upon a <br />roadway, except mechanics or test engineers making repairs or <br />adjustments.
