I.01 <br />Facility Plan Step 3 <br />' Agreement Page 2 <br />NOW, THEREFORE, in consideration of the premises and of the <br />mutual covenants hereinafter set forth, and of other good and <br />valuable considerations, the City of North Olmsted and Board of County <br />Commissioners do hereby promise and agree as follows: <br />SECTION 1: The Board of County Commissioners agrees that the <br />City of North Olmsted shall serve as lead agency in applying for a <br />grant to construct improvements to the North Olmsted Wastewater <br />Treatment Plant and the sanitary sewer system in the North Olmsted <br />Wastewater Treatment Plant Service Area. <br />SECTION 2: The City of North Olmsted shall prepare and submit <br />to the Ohio Environmental Protection Agency a Facility Plan Step 3 <br />application for improvements to the North Olmsted Wastewater Treatment <br />Plant as designed under the Facility Plan Step 2 grant and improvements <br />recommended in a Sewer System Evaluation Survey Report prepared by <br />Dalton-Dalton-Newport under an amendment to the Step 1 grant. <br />SECTION 3: The City of North Olmsted will fund the non-federal <br />share of the cost to improve the sewer system exclusively serving <br />North Olmsted users. <br />SECTION 4: The Board of County Commissioners will fund the non- <br />federal share of the cost to improve the sewer system serving Olmsted <br />Township. <br />SECTION 5: The City of North Olmsted will contract with an <br />engineering consultant to prepare plans, specifications and estimates <br />of cost for the recommended sewer system improvements in Olmsted <br />Township. <br />SECTION 6: The City of North <br />completed prior to June 20, 1983,, <br />pation to make the improvements. <br />to the County Sanitary Engineer fo <br />Township. <br />Olmsted shall have the engineering <br />in order to obtain federal partici- <br />Such plans shall be made available <br />r the portion applicable to Olmsted <br />SECTION 7: The Board of County Commissioners agrees to make all <br />sewer system improvements recommended in the Sewer System Evaluation <br />Survey (SSES) Report in a timely manner as required by the Environmental <br />Protection Agency; otherwise, a surcharge will be added to the user <br />charge to cover the cost of treating the excess inflow/infiltration <br />(I/I) removable according to the SSES Report until such time as the <br />work is performed. <br />SECTION 8: The City of North Olmsted agrees to perform the sewer <br />system improvements recommended in the SSES Report which serve North <br />Olmsted users in a timely manner as required by the Environmental <br />Protection Agency.
