} Facility Plan Step 3 Agreement Page 3 SECTION 9: The Board of County Commissioners agrees that the municipality will enter into agreement with the City of North Olmsted to implement and administer the "NEW SERVICE CHARGE SYSTEM" which is a fair and equitable user charge and is required by the United States Environmental Protection Agency and is incorporated into an agreement between the City of North Olmsted and the Board of County Commissioners authorized by North Olmsted Ordinance No. 82-136. SECTION 10: The Board of County Commissioners shall incorporate all provisions of the North Olmsted Sewer Use Ordinance for the North Olmsted Service Area in Olmsted Township after adoption by the City of North Olmsted in accordance with requirements of the Environmental' Protection Agency and proposed in the Dalton-Dalton-Newport report entitled, "City of North Olmsted Sewer Use Ordinance". SECTION 11: For performing the design and construction described in Section 5, the Board of County Commissioners shall pay to the City of North Olmsted an amount equal to the fee necessary for the City of North Olmsted's Facility Plan consultant to produce the plans, speci- fications and estimates of cost necessary to implement the recommended Olmsted Township improvements in the SSES Report and to revise the Step 3 application at a cost not to exceed Two Thousand Two Hundred Dollars ($2,200.00). SECTION 12: The Board of County Commissioners agrees to designate the City of North Olmsted as their agent in the matter administering the construction contract for the sewer system improvements in Olmsted Township as a part of the construction contract for sewer system improvements in the City of North Olmsted. The Board of County Commissioners agrees to pay the City of North Olmsted the non-federal share of the improvements in Olmsted Township, plus an administrative fee of° Two Hundred Dollars ($200.00). SECTION 13: The Board of County Commissioners shall be credited with an allowance, as determined and if granted by the Environmental Protection Agency, for the engineering design services described in Section 5 for the construction of the improvements. SECTION 14: The City of North Olmsted shall make available for inspection by the Board of County Commissioners all records relating to the services for which there is cost sharing. SECTION 15: This agreement shall take effect on the date hereof and shall be for the benefit of and shall be binding upon the successors and assigns of the parties hereto.
