AGREEME14T <br />?r <br />.THE CITY OF NORTH OLMSTED <br />AND <br />THE CITY OF FAIRVIEW PARK <br />i <br />FOR <br />? <br />FACILITY PLAN STEP 3 <br /> <br /> <br /> <br />THIS AGREEMENT made and entered into this day of , <br />1983, by and between the municipalities of North Olmsted and Fairview Park, <br />municipal corporations organized and existing under the Constitution and <br />Laws of the State of Ohio, duly authorized by the following ordinances <br />passed by their respective Councils: <br />City of North Olmsted Ordinance No. -? G on the day of <br />, 1983; and <br />City of Fairview Park Resolution No. <br />, 1983. <br />on the day of <br />WHEREAS, the Municipalities each own sanitary sewer systems; and <br />6•JHEREAS, the City of North Olmsted has completed a Step 1 Facility Plan <br />for wastewater collection and treatment in the 14orth Olmsted Facility Planning <br />Area, and a Sewer System Evaluation Survey Report, a Step 2 construction plan <br />for the improvement•of the North Olmsted Wastewater Treatment Plant and is <br />currently engaged in developing plans:for improvements to the sanitary sewer <br />system; and <br />WHEREAS, the Mayor and Council at North Olmsted desire to obtain a Step 3 <br />Federal grant to assist in the construction of improvements to the Wastewater <br />Treatment Plant recorrmended in the Facility Plan and designed under a Step 2 <br />Federal grant; and <br />WHEREAS, the City of North Olmsted and the City of Fairview Park desire a <br />Federal Step 3 grant for the rehabilitation and improvement of the sanitary <br />sewer system in the two municipalities and reimbursement for a share of the <br />design of these improvements. <br />WHEREAS, the City of North Olmsted desires a sharing of costsAfor the <br />construction of improvements to the North Olmsted Wastewater Treatment Plant; and <br />WHEREAS, the City of North Olmsted had been designated as the lead agency for <br />all Facility Plan grants in the North Olmsted Wastewater Treatment Plant Service <br />Area. <br />NOW, THEREFORE, in consideration of the premises and of the mutua]. <br />covenants, hereinafter set forth, and of other good and valuable considerations, <br />the Municipalities do hereby pr.omise and agree as follows: <br />SECTION 1: The City of Fairview Park agrees that the City of North Olmsted <br />shall serve as lead agency in applying for a grant to construct improvements to the <br />North Olmsted 4Jastewater Treatment Plant and the sanitary sewer system in the North <br />Olmsted tJastewater Treatment Plant Service Area. <br />SECTIOW 2: The City of North Olmsted shall prepare and submit to the Ohio <br />Environmental Protection Agency a Facility Plan Step 3 application for improvements <br />to the tJorth Olmsted Wastewater Treatment Plant as designed under the Facility <br />P7an Step 2 Grant and improvements recommended in a joint Sewer System Evaluation <br />Report prepared by Dalton-Dalton-Newport and Alex Kanareff and Associates under an <br />amendment to the Step 1 Grant. <br />? <br />SECTION -K The City of North'Olmsted will fund the non-federal share of the <br />cost to improve the sewer system exclusively serving North Olmsted users.
