. <br />? <br /> <br /> <br />- 2 - 0 <br />SECTION 4: The City of Fairview Park will fund the non-federal share of the <br />cost to improve the sewer system serving Fairview Park users including those <br />improvements outside the Fairview Park corporation which are recorrmended to <br />improve the sewer system for Fairview Park user.se <br />SECTION 5: The City of Fairview Park will contract with an engineering <br />consultant to prepare plans, specifications and estimates of cost for the <br />recommended sewer system improvementse. <br />SECTIOW 6: The City of Fairview Park shall have the engineering completed and <br />submitted to the City Engineer of the City of North Olmsted prior to June 20, 1983, <br />if the City of Fairview Park desires any federal participation to make these <br />improvements. Such plans shall require the approval of the City Engineer of the <br />City of North Olmsted. <br />SECTION 7: The City of Fairview Park agrees to make all sewer system <br />improvements recommended in the Sewer System Evaluation Survey (SSES) Report in <br />a timely manner as required by the E,P,Ao; otherwise, a surcharge will be added <br />to the user charge to cover the cost of treating the excess inflow/infiltration (I/I) <br />removable according to the SSES Reporto <br />SECTION 8: The City of North Olmsted agrees to perform the sewer system <br />improvements recommended in the SSES'Report which serve North Olmsted users in a <br />timely manner as required by the E.P.A. <br />SECTION 9: The City of Fairview Park agrees that the municipality will enter <br />into agreement with the City of North Olmsted to implement and administer the <br />"NEW SERVICE CHARGE SYSTEM" which is a fair and equitable user charge and is <br />required by the United States E.P.A. and is incorporated into the agreement <br />authorized by North Olmsted Ordinance fVo. 82-135. <br />2,?MMisfr?7?`??c lcrr/c cS Z.`- o6t?,., <br />SECTION 11: For performi ng the qdes4grr-descri bed i n Secti ot e Ci ty of <br />Fai rvi ew Park wi 1 l pay to the Ci ty of North Olmsted <br />?., _.. .- . .A?1C ??+iG?'?'1 !1 . oe?imnfo??m? t- ... ??//IYd (3' ?. <br />SECTION 10: The City of Fairview Park shall incorporate all provisions of the <br />North Olmsted Sewer Use Ordinance for the Service Area after adoption by the City <br />of North Olmsted in accordance with requirements of the United States E.P.A. and <br />proposed in the Dalton-Dalton-Newport Report entitled "City of North Olmsted Sewer <br />Use Ordinance" ' <br />des <br />he <br />equal to 9 percent) times t <br />te <br />SECTION 12: The City of North Olmsted shall make available for inspection by <br />the City of Fairview Park all records relating to the services for which there is <br />cost sharing. <br />SECTION 13: This agreement shall take effect on the date hereof and shall be <br />for the benefit of and shall be binding upon the successors and assigns of the <br />parties hereto.
