•+ •.4?•. ? ? .. . . . . <br />?«. <br />CI'TY Ok' NORTH OLMSTED <br />• ORDINANCE N0. 83-81 <br />PAGE FOUR. <br />For the purpose of this paragraph, sudden and accidental in.jury shall <br />include such incidents as injury resulting from a motor vehicle accident; smoke <br />inhalation; burns; falling debris or collapse of building; slipping; tripping <br />and falling, and the like. It shall not be considered a sudden or accidental in- <br />jury or incapacity resulting from the lifting of objects, heart failure or heart <br />attack. <br />All full-time members of the Fire Department shall receive twenty-four <br />(24) hours of duty time off, if requested, due to death in the immediate family. <br />"Immediate family" in case of death, shall be interpreted as meaning the spouse <br />and children of the employee. <br />Any member of the department who qualifies for benefits under Paragraph 1 <br />hereof shall be required to pay over to the City any amounts received from the <br />Bureau of Workmen's Compensation as supplemental wages. Further, if at any time, <br />the City determines on the basis of inedical evidence, that an employee is perman- <br />ently disabled and will no longer be able to carry on his duties, then the City <br />ma.y terminate payments and insist that the employee go on a pension program. Any <br />employee who qualifies for the benefit, under this paragraph, shall not have his <br />accumulated sick time reduced because of a qualified accident injury which <br />occurred while in the line of duty. <br />Any employee, at the time of his retirement, may elect to receive all <br />benefits due him, in one lump sum nayment. <br />SECTION 3: That the employees of the Fire Department of the City of North <br />Olmsted be reimbursed, not to exceed three dollars ($3.00) per day for per diem <br />expenses while in attendance at the Firemen's Training School established by the <br />State of Ohio at a place designated by the Fire Chief, which school is for a five <br />(5) week period with twenty-five (25) days of class attendance required. <br />SECTION 4: That there is hereby established certain rights, rules, and <br />regulations with respect to employee grievance procedure. Said grievance pro- <br />cedure is set forth in Exhibit "A°" which is attached hereto and made a part <br />hereof. Said grievance procedure shall be incorporated within the rules promulgated <br />and adopted by the Chief of the Fire Department and Safety Director for the govern- <br />ing of the Fire Department in effectuating Civil Service Laws of the State of Ohio <br />and the rules and regulations of the North Olmsted Civil Service Commission. <br />SECTION 5: That the Clerk of_ Council be and she is hereby directed to <br />forward a copy of this Ordinance to the Director of Finance in order that the <br />Director of Finance can pay the compensation, as hereinabove set forth, and a copy <br />of this Ordinance shall be forwarded to the Fire Chief. <br />SECTION 6: That Ordinance No. 82-50, adopted May 18, 1983, is hereby repealed <br />and any other Ordinances or Resolutions or parts of Ordinances or Resolutions in- <br />consistent herewith are hereby repealed with the effective date of this Ordinance. <br />SECTION 7: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of_ the public health, safety and welfare, <br />and for the further reason that it is immediately necessary for the continuity of <br />service of the safety forces of the City, and further, provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor.
