TALLON <br />AN ORDINANCE AMENDING SECTIONS 1-000.02 and 1.000.07 OF' <br />CHAPTER 1000 OF THE CODIFIED ORDINANCE$ DF_.THE CITY OF <br />NORTH OLMSTED, ENTITLED, "SUBDIVISION OF LANll." <br />WHEREAS, the Council has been advised that developers of land within <br />the City of North Olmsted have, on occasion, sought variances from the <br />Board of Zoning Appeals for non-conforming proposed subdivisions before <br />submitting their proposed subdivisions to Planning Commission for review <br />and approval; and <br />WHEREAS, the Council recognizes that, by Charter, the Planning <br />Commission is vested with the authority to act and function as platting <br />commissioners for the City; and <br />WHEREAS, _it is the intent of this Council to amend Sections 1000.02 <br />and 1000.07 of Chapter 1000 of the Codified Ordinances of the City of <br />North Olmsted, entitled, "Subdivision of Land," so as to provide a <br />procedure for the submission of non-conforming propsed subdivisions to the <br />Planning Commission prior to application to the Board of Zoning Appeals for <br />variances. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OhIO: <br />SECTION 1: That Sections1000.02 and 1000.07 of Chapter 1000 of the <br />Codified Ordinances of the City of North Olmsted, entitled, "Subdivision of <br />Land," which now read': <br />1000.02 Ma'or Subdivisions = Procedural Requirements <br />(a) Any developer who desires to present a major subdivision to the <br />City shall make application to the City Engineer. The City Engineer shall <br />supply the developer with all the rules and regulations of the Planning <br />Commission of the City of North Olmsted, as well as any pertinent <br />ordinances dealing with the subdivision or land. Any person submitting a <br />proposed subdivision shall submit with his application a preliminary plan <br />and location map, a topographic map, a plat, improvement plans, and other <br />necessary documents, such as easements and title insurance documents. <br />(b) A preliminary plan and location map shall show the type of zoning <br />of areas contiguous to the land to be platted. Said preliminary plan and <br />location map shall contain the following information: <br />(1) A certification showing that the preliminary plan was prepared <br />by a grofessional Land Surveyor registered in Ohio. <br />(2) The preliminary plan shall be accurately drawn to the scale of <br />one inch (1") equals one hundred feet (100') unless waived by the <br />City Engineer. Dimensions from the County Auditor's map may be <br />used. <br />(3) The preliminary plans shall show all existing streets, <br />including intersections, forming the periphery of land to be <br />developed; the street and lot lines for the area to be developed; <br />the existing and proposed location of drainage ditches; the existing
